Exclusive Interview with CDR Charles F. Kerchner, Jr. (Ret) on His New Book, Part II

(Jan. 13, 2025) — On Wednesday, January 8, The Post & Email conducted an interview with CDR Charles F. Kerchner, Jr. (Ret) about the publication of his latest book, “Kerchner v Obama & Congress/Petition for Certiorari (10-446)/To The U.S. Supreme Court –/The Public Advertorial Campaign,” on January 6, 2025.

As we reported, the soft-cover, “coffee-table” publication comprises the totality of Kerchner’s advertisements carried in The Washington Times National Weekly Edition over more than four years, beginning in July 2009 and concluding in December 2013.

The book also contains the lawsuit referenced in the title which Kerchner and three others filed claiming Barack Hussein Obama had not proved his eligibility for the presidency as a “natural born Citizen” as required for the nation’s chief executive in Article II, Section 1, clause 5 of the U.S. Constitution.

Perhaps most significant, the book’s preface consists of a personal account from Kerchner of his background and reasons for seeking “the truth” about Obama, an element he felt was being purposely obscured from the American electorate as they prepared to elect a new president.

Prior to Obama’s 2008 election, credible reports, including Obama’s own biography, stated him as born in Kenya or Indonesia rather than Hawaii, as was claimed later. Moreover, his claim of a foreign-born, non-U.S.-citizen father raised further questions about his eligibility among some constitutional scholars, researchers and average American citizens.

In our interview, Kerchner recalled fondly the attorney who worked pro bono on Kerchner v Obama, Mario Apuzzo, who passed away in October 2021 at the age of 65. “I miss him; he was a dear friend. He was a great scholar and a great writer,” Kerchner said.

His motive in assembling the book and entering it into the Library of Congress, Kerchner said, was, “I wanted to get it all out there in a book so that someone who didn’t live through it could see some of the work that was done to try to expose what was going on, the corruption, the subversion, the anti-American culture, the open borders” emanating from the Obama White House.

“Obama wrote a book, Dreams from My Father, because his father was his inspiration,” Kerchner continued. “His father hated America; he was never an immigrant to this country and went back to his home country, and he hoped and prayed that some day America would be brought down.

“Obama II was implementing his dream; that’s why he wrote the book.

“People who read his book would know what he had in mind if he ever got power. He did exactly what he said he was going to do; he implemented the dreams of his father.”

“I’ve seen his father described as ‘socialist,’ The Post & Email observed,” to which Kerchner replied, “He was a Marxist. He practiced his religion of birth, Islam, but he was really a secular Islamist, a radical Marxist and anti-American. He considered America a colonial power; he hated the British and colonial power. He hated America because they deported him because of all his womanizing.”

“Can anyone get a book catalogued by the Library of Congress?” we inquired.

“You have to send them a physical copy of the book; you have to apply to get it accepted, and you have to give them a description of the book, the title and what it’s about, and they have to decide if they want to accept it. They’re pretty accepting, but if you want to get it in the right section, you have to target your book in that way. That’s why I picked my federal lawsuit to the Supreme Court as something that would be historically important and widely talked about in law curriculums as an example of someone – my co-plaintiffs and I — who doesn’t have ‘standing.’ As a military officer I took an oath to the Constitution and claimed to be damaged, but the Supreme Court uses monetary damages for the standard. Justice Scalia wrote a description of what you need to get standing.”

The Supreme Court therefore should have held oral argument in his case, Kerchner said.

“If you look at my ad on page 31 and 32, I have Chief Justice John Marshall’s ‘voice from the past’ where he said, when it comes to the Constitution, the Court ‘must take jurisdiction if it should.’ It’s treason if you don’t — I use the word ‘treason.’ The Court can decline jurisdiction in a lot of cases, but when it comes to the Constitution, they must take jurisdiction.”

Further and as Kerchner noted, Marshall wrote, “We cannot pass it by because it is doubtful. With whatever doubts, with whatever difficulties, a case may be attended, we must decide it, if it be brought before us.”

“That’s long gone now; that was in 1821, when we still had people who believed the Constitution is a rigorous contract that must be strictly enforced,” Kerchner continued. “The term ‘natural born Citizen’ has never been adjudicated in the Supreme Court as a first-impression issue which applies directly to the president; they should have taken this case on that basis alone.”
