(Dec. 17, 2020) — On Wednesday the plaintiff in a lawsuit alleging that U.S. Senator Kamala D. Harris, who is now the putative vice-president-elect, has filed a complaint with Washington, DC chief of police, Peter Newsham.
In late August, New York State citizen Robert C. Laity filed his suit with the U.S. District Court for the District of Washington, DC on the grounds that Harris, who was born in Oakland, CA to parents present in the country on student visas or extensions thereof, is not a “natural born Citizen” as required by Article II, Section 1, clause 5 of the U.S. Constitution.
The 12th Amendment mandates that any vice-presidential candidate meet all of the qualifications for presidential eligibility.
Laity’s suit was dismissed by Judge Emmet Sullivan last month, after which he appealed through an emergency motion to the United States Court of Appeals for the DC Circuit, where it is pending under case #20-7109.
In his letter to Newsham, Laity contended:
There is evidence that would lead a reasonable person to conclude that Kamala Devi Harris and Joseph R. Biden are constitutionally encumbered from becoming Vice-President and President of the United States. I allege that Kamala Devi Harris is ineligible to be Vice-President under the 12thAmendment and Article II, Sec. 1, Clause 5 of the U.S. Constitution. Harris is not an Article II “Natural Born Citizen”.
Laity’s complaint extends to putative president-elect Joseph R. Biden and Speaker of the House Nancy Pelosi, he said, because of his allegation that they “are complicit in the past usurpation of the Presidency by Barack Hussein Obama, Jr. who is also not an Article II ‘Natural Born Citizen’.”
“Biden and Pelosi are now compounding their complicity with Barack Obama’s usurpation of the Presidency, by fraud, by now being an accomplice to Kamala Devi Harris’ attempt to do the same,” Laity claimed.
He recounted to Newsham his filing of a similar complaint in 2010 regarding Obama with his local chief of police, followed by Newsham’s predecessor, Cathy Lanier; the U.S. Attorney for the District of Washington, DC; the FBI and the Secret Service. Obama, although credibly reported to have been born outside of the United States prior to his first presidential run in 2008 as well as claiming a non-U.S.-citizen father, was permitted to serve two terms in the Oval Office and now jokes about the reported circumstances of his birth.
“Since Barack Obama usurped the Presidency in 2008 and again in 2012, it has now become quite evident that a pattern of usurpations of the Presidency and attempts to do so is overtly demonstrable,” Laity wrote to Newsham. “In the last 12 years alone there have been no less then (7) seven constitutionally barred individuals who have attempted to become President or Vice-President ultra veres.“
According to The Free Dictionary, the Latin term means, “beyond the powers.”
In closing, Laity asked Newsham to “take these complaints more seriously then did your predecessor” due to his contention that “Usurpation of the Presidency and/or Vice-Presidency byfraud, during time of war is a very grave matter of national security.”
Laity is author of the 2017 publication, “Imposters in the Oval Office.”
