Army Holds Legal Motions Hearing July 7 in Sgt. Bergdahl Case

FORT BRAGG, N.C. – Army Judge Col. Jeffery R. Nance convened an Article 39(a) Motions Hearing July 7 on Fort Bragg, N.C., in the case of United States vs. Sgt. Robert B. Bergdahl. The July 7, 2016, military legal hearing convened at 9:02 a.m. EDT and adjourned at 2:18 p.m. EDT.

Trial counsel present were Maj. Justin C. Oshana with assistant trial counsel Maj. Jerrod Fussnecker and Capt. Eileen Whipple. Defense counsel present were Mr. Eugene Fidell and Lt. Col. Franklin D. Rosenblatt, with assistant defense counsel Maj. Jason Thomas, Maj. Oren Gleich, Capt. Nina Banks and Mr. William Helixon.

The military judge discussed specific legal motions by trial counsel and defense counsel, including those relating to access to documents and E-mails potentially associated with this case.

The next scheduled motions hearing for this case will be Aug.10, 2016. The court set Feb. 6, 2017, as the start date for the trial, subject to possible future court-docket scheduling changes.

Forgetting my sarcasm, does anyone else see how the trial date is scheduled after Barry pardons Bergdahl.
