(Dec. 15, 2024) — On Saturday’s edition of “Life, Liberty & Levin,” host Mark Levin’s opening monologue immediately focused on immigration and “national identity,” quoting from works by political scientist and Pres. Jimmy Carter adviser Samuel P. Huntington and historian and JFK presidential adviser Arthur M. Schlesinger, Jr.

“In a variety of ways,” Huntington wrote in “Who Are We?: The Challenges to America’s National Identity (2005),” Levin quoted, “the American establishment, governmental and private, has become increasingly divorced from the American people,” causing those in power to morph into “an unrepresentative democracy” by opposing the will of those who placed them there.

Levin compared Huntington’s ruminations to Trump’s “landslide” re-election last month in light of his focus on border security and “mass deportations” of illegal aliens. “The people support it,” Levin said. “Now the media are pushing back; the Democrat Party is pushing back; academia is pushing back; the same so-called elites, the same ruling class, the same establishment that put us in this position now with massively open borders…”

The Democrats’ purpose in embracing birthright citizenship, which is the awarding of U.S. citizenship to anyone born within the country’s borders, and liberal immigration policy, Levin declared, was to secure their position as a “monopoly party” “for the next century.”

Transitioning, he asked, “What is birthright citizenship? We hear this,” referencing NBC News’s Kristen Welker’s contention in a post-election interview with Trump that the “14th Amendment” precludes Trump’s presumed authority to rescind the policy of birthright citizenship with an executive order.

“You promised to end birthright citizenship on Day One,” Welker was shown recounting to Trump at the outset of the interview clip. “Is that still your plan?”

“Yuh, absolutely,” Trump responded.

“The 14th Amendment, though, says that, quote, ‘All persons born in the United States are citizens,'” Welker responded. “Can you get around the 14th Amendment?”

“That’s not what the 14th Amendment says in Section 1,” Levin abruptly said once the clip concluded. “She’s a liar. She’s not the only one…It says, in relevant part, ‘All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.’

“The fact that you’re born in the United States isn’t enough,” continued. “There’s been no law passed — none — that conveys birthright citizenship onto illegal aliens or their children. There’s been no Supreme Court decision that definitively confers birthright citizenship onto illegal-alien children, none. Nobody’s 100% certain how this came to be, but everybody seems to be 100% certain that the president can’t fix it. Well, does the Constitution confer birthright citizenship on children of illegal aliens? Of course it doesn’t.

“What does ‘jurisdiction’ mean?” he continued. “She purposely, purposely read it out of the Constitution. Does it mean geography? ‘Jurisdiction’ has nothing to do with geography…it had to do with political allegiance to the United States of America. Now how do we know this? Because that’s what the authors said it meant.”

He provided examples of foreigners whose children are born in the United States by happenstance. “Does that make their children American citizens?” he asked his audience. “…Of course not; we don’t confer citizenship on the children of tourists and diplomats and students. Why, then, would we confer citizenship on the children of illegal aliens? Well, the Constitution doesn’t.

“‘Jurisdiction’ means “subject to the laws and rules of the United States,’ he expounded. “It does not mean the conference of citizenship by the fact of one’s physical presence in the United States. This has absolutely nothing to do with the history of the 14th Amendment; it does not support that view. On the contrary, this part of the 14th Amendment, which is one of three post-Civil-War amendments…it was addressing the fact that recently-freed slaves were to be treated as full citizens throughout the United States.”

As The Post & Email has extensively reported, Joe Biden’s vice president, Kamala Harris, was born in 1964 to parents both of whom arrived in the U.S. for higher education on student visas. Her father did not naturalize until 1981, and there is no evidence her mother ever became a U.S. citizen.

Didn’t get the opportunity to watch the entire Levin program but what many misinterpret about the 14th amendment is the passage subject to the jurisdiction thereof which unequivocally means sole jurisdiction of the United States. This is known for when Congress passed the 14th amendment they excluded Native Americans because Congress deemed them subject to tribal jurisdiction.
Not only don’t illegal aliens meet the criteria of the 14th amendment neither do certain individuals who come from parents with mixed citizenship.
The US Govt has rules for dual citizens and those rules state that dual citizens are subject to the jurisdiction to all countries in which they hold citizenship which would mean individuals who acquire their parents citizenship automatically at birth wouldn’t meet the 14th as they’re subject to foreign jurisdiction.

Well Mark Levin, aka Mr. Great one, why didn’t you state, because of the above truthful statement you just made, that Kamala Harris was not a Citizen at/by Birth (CAB) of the United States when she was born to parents who were both students here in the USA temporarily on student VISA’s! And not even being a Citizen at Birth, Harris certainly could not then have two more adjectives applied to the noun, i.e., she thus could not be a “natural born Citizen” (nbC) at birth either.

Levin and others with the big megaphones could have prevented the country from going through the nightmare governance under Obama and Biden and could have stopped the unconstitutional seating of Obama and of Harris. But he chose to remain silent when it really counted. And he chose to shout down call-ins to his radio show anyone who brought up the issue, and to ignore people who challenged him to debate the issues of “birthright Citizenship” and “natural born Citizen”. Now he wants to come over to the right side, to the truth, about CAB and NBC terms.

I remember at a Value Voters summit in Washington DC many years ago during Obama’s first term, that I and another person personal approached Mark Levin who was one of the guest speakers at the event, and handing to him information about the Minor v Happersett (1875) U.S. Supreme Court holding and decision which stated what a “natural born Citizen” is without any doubt. He said at the time he “had not read that case”, which to us was unbelievable, and that he’d look at it. We told him he should read it and speak out about it. He never did speak out about it and never did get back to us. Thus his comments to us at the time were pure B.S.

I believe he has known the truth about the CAB and nbC terms all along all along, but kept silent on purpose to keep his radio show and other media outlets available to him. So his personal financial status was more important to him back then, or fear of the racism charge, such that he chose to do nothing to stop Obama’s unconstitutional rise to the Oval Office, and put roadblocks in the way of others who tried. How does he continually get away with what he does! I don’t know.

When CDR Kerchner (Ret) speaks to Mark Levin concerning the legitimacy of Obama and Harris, plus the illegality of birthright citizen status, Mark Levin’s feet are on fire.

Mark Levin – “Hello caller, this is Mark Levin; what can I do for you”?
Caller – “Mr. Levin, what do you think about the fact that Obama is an undocumented alien and not even a citizen of the U……..”

Yes, Atty Mario Apuzzo and I took up his challenge and offered to debate him but Levin never responded.

And then there was,Judge Napolitano, who took the same evasive tactic when the good judge asked his audience via an online poll, who they wanted to have him interview, and on what subject, on his show, and the audience overwhelmingly selected Atty Mario Apuzzo on the subject of “natural born Citizen”. Never heard from the old Judge again nor did he challenge his audience for a subject for a long time. And now he too is seeking to get back in the limelight, it seems, since I see him more and more being asked for constitutional commentary on various shows.
