AN “ASSAULT ON THE RULE OF LAW”

July 7, 2016

Congressman Chuck Fleischmann
U.S. House of Representatives
Washington, D.C.  20515

Mr.  Fleischmann,

I expect you to personally read this letter, which is going to be very blunt.   FBI Director James Comey’s decision to not pursue an indictment of Hillary Clinton on criminal charges is the straw of corruption that has broken this camel’s back.

That Hillary Clinton deliberately (intentionally), contemptuously and arrogantly broke the law with her re-routing of government email to her private servers is obvious to anyone who has a functioning intellect.

In Comey’s own statement announcing his decision to turn a blind eye to Clinton’s crimes he admits that the FBI found that at least 110 classified emails were sent or received on Clinton’s private server. (And how many more were on the thousands of emails she destroyed as part of her cover-up.)   But Comey then says: “[W]e did not find clear evidence that Secretary Clinton or her colleagues intended to violate laws governing the handling of classified information…”  That is Baloney!

Clearly the first statement contradicts the second. At the very least, among the laws relating to, and forbidding, Clinton’s deliberate transference of classified materials to her private server is this one:

18 U.S. Code § 1924 – Unauthorized removal and retention of classified documents or material:

(a) Whoever, being an officer, employee, contractor, or consultant of the United States, and, by virtue of his office, employment, position, or contract, becomes possessed of documents or materials containing classified information of the United States, knowingly removes such documents or materials without authority and with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than one year, or both.

I don’t think any jury would buy the notion that Clinton transferred those classified materials to that private server while sleep-walking, or that she didn’t intend to retain them in that unauthorized location. The removal was knowingly and deliberately done, and the intent to retain the materials in the unauthorized location is manifest.

Comey’s assertion that “no reasonable prosecutor” would bring a case relating to these events is ludicrous.  Properly read, Comey is really saying, “While any prosecutor would bring an indictment against anyone else in a case like this, Candidate Hillary gets a pass.”

This is not acceptable.  Hillary Clinton should be treated by the United States law enforcement apparatus in exactly the same way that her gardener would be treated if the FBI had the same evidence of wrongdoing against him as it has against her.   The United States Constitution clearly prescribes equality before the law across the board. Treating a political operative like Clinton the least bit more favorably than how anyone else would be treated for the same behavior is a violation of Comey’s oath of office, in which he swears to support and defend that Constitution.

Consequently, I want Comey condemned and removed from office. And I ask you to dedicate all of your efforts towards this end until they are accomplished.

Among all the things that those in your position can lawfully do, the preservation and supremacy of the rule of law is by far the most important. It is more important than any political initiative or program, period.

Further, my good congressman, tolerating Comey’s assault on the rule of law would be a violation of your own oath of office. Therefore, I, and the hundreds of patriot on my email list, expect you to do everything in your power to secure Comey’s condemnation and removal from office, and thereby preserve the rule of law. Congressman, I want you to go to the wall on this. I want no compromise, no quarter, no deals. I want you to inform any and all Republicans and Democrats in Congress who might be tempted to stand in the way of this remedy for partisan reasons that should they do so, they will never again get support from you, in any form, for anything.  This should be the primary thing on your agenda from now until Comey is chastised and a law-respecting replacement has taken his office.

Congressman Fleischmann, here is the urgent and ultimate consideration:  Our beloved America is in great jeopardy, and the very existence of this nation as a constitutional republic is seriously threatened. To ignore, permit or facilitate in any way the possible election to the Presidency of a criminal like Hillary Clinton is TREASON!

I thank you for your respectful attention to this letter, Chuck.  Moreover, I expect a personal response. I supported you from your first campaign, but because the threats to America are now even greater, I must demand even more from you now — more dedication, more leadership and more courage.

Dr. John Grady, M.D.
