Action Alert! – Exciting Amnesty Update!

If you think nobody is paying attention or that what we do makes no difference, it’s because to are not engaged enough in helping us do it…On 11/19/14 we submitted a brief regarding Illegal Obama Amnesty to select members of Congress and then, we asked our active members and supporters to do the same. That evening we released the brief to the general public via our North American Law Center (NALC) and the brief went viral on the web.In the brief, we made the following first recommendation to congress on how to stop Obama’s illegal amnesty…“House Republicans can immediately move to pass a House Resolution declaring that Barack Hussein Obama has no constitutional authority to regulate Immigration and Naturalization rules, delegated as a sole authority of the U.S. Congress in Article I – Section 8 enumerated powers of Congress, nor any power to circumvent or subvert the Rule of Constitutional Law via Executive Order. This resolution will render any Executive Order on amnesty “null and void” on arrival, making it an illegal act for Immigration and Naturalization officials to act on that illegal order.”

By end of business on 11/20/14 – Rep. Yoho from Florida and several co-sponsors had introduced exactly what NALC had recommended in H.R. 5759 of the 113th Congress, which states –

“(a) In General.–No provision of the United States Constitution, the Immigration and Nationality Act, or other Federal law shall be interpreted or applied to authorize the executive branch of the Government to exempt, by Executive order, regulation, or any other means, categories of persons unlawfully present in the United States from removal under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act). Any action by the executive branch with the purpose of circumventing the objectives of this statute shall be null and void and without legal effect. (b) Effective Date.–This Act shall have effect retroactively, and shall apply to any such exemption made at any time.”

Now, before all of the armchair legal experts begin downing this House Resolution, allow us to explain why we recommended a House Resolution in this case…

1. No new law (bill) is needed to make what Barack Hussein Obama did both illegal and unconstitutional.
2. A Joint Resolution or Bill would have to pass the Democrat controlled Senate before being enacted into law.
3. All that was needed in this case was a House Resolution supported by existing Constitutional Law to declare Obama amnesty action “null and void” on arrival, based upon undisputed related laws.
4. Once House Republicans pass this H.R. 5759, it will be officially “illegal and unconstitutional” for any law enforcement agent or agency on America to act on Obama’s illegal order and everyone will be on notice…. hence, the end of Obama’s amnesty action.

In this case, H.R. 5759 is not some symbolic gesture with no legal impact. Because the resolution is an affirmation of existing law and constitutional authority, it represents STEP ONE on the road to shutting down the Obama regime and upholding the constitutional separation of powers in our country.

STEP TWO in our brief from 11/19/14 reads –

“House Republicans can immediately file Articles of Impeachment in the House Judiciary Committee, naming all Democrat co-conspirators to include Vice President Joe Biden, Senate Leader Harry Reid and House Minority Leader Nancy Pelosi, making it impossible for any of them to succeed Barack Hussein Obama in the constitutional line of succession to the Oval Office.”

STEP THREE pertains to a Senate conviction and removal from office during the 114th Congress when Republicans will control both chambers.
