HOW DO WE RESTORE THE U.S. CONSTITUTION AS THE LAW OF THE LAND?

(Apr. 22, 2011) — I thought it was the officers who ran the military. Honest mistake, really, if you were never in the military. But, once in, you quickly realize that if you want anything done, you ask the people who make it happen, the Sergeants and Chiefs. Just before Obama’s first State of the Union address, I told my wife to see if the members of the Joint Chiefs of Staff shake his hand and if they did, I told her that this country is in for some serious trouble. Well, they did and we are.
And then a year or so later LTC Terry Lakin would like to know if his Commander-in-Chief is eligible to hold the office of president and would like to see the birth certificate, and not some phony meaningless piece of paper, and for that Lakin was kangarooed into Leavenworth. The Joint Chiefs of Staff could have, SHOULD HAVE, stepped in and made sure that the proceedings were done by the book, but they didn’t (no surprise, since they all shook his hand). So much for the officer corps, but God Bless Terry Lakin.
Meanwhile, investigative journalism is now found in the Jurassic dinosaur exhibit, something that we know used to exist (reference Woodward and Bernstein) but doesn’t anymore. Same goes for “We’re Looking After You,” and other once-popular television editorials that once, it is rumored, at least hinted at the truth. Gone, long gone. Truth is no longer a commodity: truth has become an unwanted distraction, not by the listeners, but by the tellers.
Next up is the judiciary, or I should say next down, third to fall into the gutter of hopes and dreams. I have news for all judges reading this, and show this to your peer group: every citizen in this country has an equal standing to know whether his or her de facto President is legal or just a two-bit con. There are no privileged classes in America. It make no difference if you have been a Senator for twenty years or if it’s your first week at McDonald’s bagging fries, if you’re a police officer in Rapid City or a secretary in El Cajon. Every United States citizen has an equal standing. And we might as well throw Congress in with the sleazy judges, since they fit right in.
So we’ve eliminated the Joint Chiefs of Staff, the Media, and the Judicial/Congress from those who could have saved our republic to aiding its destruction. But we have one more avenue (actually two) left on our countdown list. This last group can make it happen: they have the numbers, they have the experience, and, just as important, they have the weapons.
Calling all Chiefs and Sergeants! Put that coffee cup down and listen up. You, that’s right, get your men together and take over this government. Arrest everyone, we’ll sort it out later. You see, we citizens don’t fear you, for we know your devotion to the Constitution is just as strong as ours. Once you kick all the bums out of Washington, name a civilian President to hold office until 2012. Name someone who isn’t a politician; Donald Trump will do. Let him straighten this mess out, and then in a year or so, maybe he’ll want to continue or say the heck with it. The point is, we need your help to get rid of the crooks in Washington now.
I’ll help, and there are thousands more like me who will lend a helping hand to restore the Constitution as the law of the land. We’ll find those who are responsible for voter fraud. We’ll deport every illegal immigrant and Muslims. We’ll free Terry Lakin and let him call the shots on the (real) court martial of the Joint Chiefs of Staff.
The point is that we don’t have to take it anymore. There are many ways out of the hole that’s been dug: we have to get out of it.
LTC Lakin was railroaded pure and simple. He was denied His rights under Article 138 UCMJ. I had written to his defense council and informed them of this defense but evidently they had already sold Him down the river with the Prosecutor for expediency.
I had written over 2 years ago how to remove Obama utilizing Article 138 UCMJ on my Radio Show ,The Weekly Candor on Plains Radio as well as Patriot’s Heart Network. Even Leo Donofrio said my idea was plausible within His Blog. In addition Orly Taitz gave it great credence and included it within her suits with active duty Military and other discussions.
To say the least I was surprised to see that LTC Lakin had used the Article 138 under UCMJ.
The reason the Army denied LTC Lakin His rights was due to the fact that they didn’t allow the 138 to run its’ course.LTC Lakin wrote out His perceived grievance regarding USURPER Obama’s ineligibility( I never say eligibility as I don’t lie). He then Properly submitted this to His immediate Superior officer who had court martial authority over Him. His Commander told Him that the Article 138 didn’t apply which was very wrong as it could be a PERCEIVED and not actual wrong that LTC was demanding redress for. In any event, His commander did the proper thing in passing it on to the General Officer excercising Court Martial Authority over Him, even though it was initially turned down By LTC Lakin’s Commanding Officer.
The General denied the redress by LTC Lakin but this is where LTC’S Lakin’s rights were trampled.
The General after denying LTC LAKIN”S redress should have then forwarded it on to the Commander exercising Court martial authority over him WHICH HE DIDN’T. HE SIMPLY REFUSED THE REDRESS OF LTC LAKIN!
AfterThat General turned it down , He was required to continue sending it up the chain of command in getting a yes or no for LTC Lakin’s request until it ended up at the JOINT CHIEF OF STAFF, the highest Military authority for final disposition. Then and only then could LTC Lakin’s request for redress under Article 138 UCMJ be finalized LTC Lakin’s request under Article 138 never reached the CJCS as was required under Article 138 UCMJ therefore His rights were trampled upon.
In short, each commander authorizing General Court Martial over the other Commander could turn LTC’s Lakin’s request for request ( article 138) but they were then COMMANDED to forward that denial to the Commander with general Court Martial Authority over them for their opportunity to grant redress to LTC Lakin which they failed to do. Therefore it never reached the Chairman Joint Chief of Staff as it was suppose to.
I can’t understand why LTC Lakin’s defense never researched and used this after my informing them of it.
Most people within the Military do not know of this rarely used article within the UCMJ. One of the benefits of it was that anyone could use it WITHOUT EVER BEING SUBJECT TO ANY DISCIPLINE FOR SEEKING REDRESS!
iI served 2 decades in the US Army in the Field Artillery branch including Vietnam. I successfully utilized the Article 138 UCMJ while being a Staff Sergeant assigned to the 2bn 3rd Field Artillery Bn 9th Inf Div, Ft Lewis was in 1976. I brought an entire Artillery Battalion to a screeching halt while the Battalion Commander consulted JAG to see what to do. I won the Article 138 request for redress after it just went to my Battalion Commander. he had to publicly apologize to the entire Battalion( 500 man) for a wrong He done to me. I was determined That my Lt. Col would never get away with disrespecting me and I searched all within the Army Regulations and found this Article. From that day on I never forgot Article 138, UCMJ.
There still be something that LTC Lakin can do to win an appeal due to His rights being stripped under Article 138 UCMJ.

Constitution law abiding citizens resisted the forced change. The best hope of change for the citizens is through election in November 2012. Meanwhile waiting long it guises into passive to active reflections. Complacent civilians though not all may prefer the waiting if there is one coming. Disciplined military the objective oriented the waiting is least likely forthcoming. “Coup detat” is fearsome reality for civilians to take and they would rather endure a government ill-suited manipulations of a real-life Usurper. “Coup detat” is military version, revolution to collective mass protest is civilian means to put an end. Election process works as the Constitution works. Since 2009 the US Constitution ceases. Deal with it. Writers here and there can keep on writing articles and we can keep on writing comments till exhaustion.
This one and legions pissed-off VW veterans make sense to put an end to this mess. Ask not what your country can do for you, ask what you can do to your (beleagered) country – JFK.

The people in “charge” are not taking charge…just heard through the grapevine something big is going to collapse in May…FEMA people told a client, finish your paperwork in two weeks or you will NEVER get a chance to get your claim paid for. The men who went through this before us (forefathers) urged that should the government become untenable, it must be dismantled and started over. Imagine if they had just sat around and talked about their situation, there would never have been a USA. They’ve done the heavy lifting and most died as paupers. That should tell you what needs to be done now. Those who can’t or won’t see that we are being painted into a corner, are like maidens in distress waiting for a knight in shining armour. The constitution is a moment away from a death rattle and we’re sitting here discussing how things should be. It’s time to make something major happen. No matter how many are complicit, we still outnumber them, yet everyone is yakking while they bury us under financial burden. We already know that they have blocked off every legal means of redress. Think of Lts Col Fitzpatrick and Lakin. The constitution isn’t working very well for them; they are suffering while we chit chat. There by the Grace of God and our own lethargy go we.

I agree to a point with your view, but we are at a place where the people who raised their right hand and swore an oath to The Constitution have neglected their duty that we elected them for. And now the people who make, enforce, and judge the laws are working in direct opposition to We The People. AND they have their office to hide behind.
Take back by law?? Who is going to fortify us when these cowards say No I’m Not Going and You Can’t Make Me? Believe it or not, we have passed the point in time where Our Constitution means something. Now it is a nuisance to their agenda. And we are day by day becoming less and less important.
You can say wait until the 2012 elections. If something is not done right now, we as a nation will not survive until Nov 2012. Remember only 30% of the colonists started and won the American Revolution. The other 70% sided with the King of England.

I don’t think we already have 30% of the people ready to move yet. The polls only tell us the majority is concerned, not how many are going to act on their concern.
My answer is YES!
My continuing belief is that the simplest way to bring our grievances to the attention of the whole country, and more importantly, to bring the whole country onboard, is to peacefully bollix up the wheels of government as much as possible. Since we cannot all go to Washington, D.C. to participate in such an effort, the most logical way would be to demonstrate in every city and town — or selected cities. Not just one day but every day for multiple weeks. For as long as it takes. With continuing demonstrations, I think the effort would have a great chance of snowballing into something that would force our politicians to sit up and take notice, and to finally demand obama be investigated, tried, convicted, then ousted, and sentenced for treason, fraud, and theft, and then hung. And yes, our actions would require a little coordination. FYI — this isn’t something new. It has been done elsewhere. Successfully.

You say we still have a Constitution. OH REALLY! And our elected officials are abiding by it? The FBI/Homeland Security thugs that visit citizens that write to judges when the letter doesn’t contain a threat. They abide by the Constitution?
If they do not then there is NO CONSTITUTION. The last hope for a peaceful end to this Coup d’ Etat is that the ineligibility issue is brought to the attention of the public and ALL of the congress members, political party hacks, big money marxists, corrupt judges are appropriately dealt with.
I still cannot get my head around the irony of the formal requirement for LTC. Lakin to provide a “valid” birth certificate, certifying that he is eligible to RE-DEPLOY into a combat theater, yet the CIC has NO similar requirement or will NOT provide a “similar” document to certify that he is eligible to actually give the orders for LTC. Lakin or ANYONE else to deploy into a combat theater!
Well, while I’m all for getting the imposters out, we do have a constitution and I still believe in it. Just because someone usurps the office of the presidency doesn’t mean we need to throw the constitution under the bus. We need to use it to get our country back on the straight and narrow.

just which section of the constitution is that in? Peacefully, by law, removing the usurper will leave us stronger. A Coup d’Etat will only destroy the constitution.
While I’m at it, I just saw the news that McCain is endorsing the al qaeda and Jihadist extremists in Libya that is opposing Qadaffi. What an idiot. I used to admire him but now I realize he is just Obama lite. He is capable of doing just as much harm as obama is.
I don’t know how we get out of this mess, but we need to do it soon, I don’t personally like the idea of a “mombasian candidate” running our government.
As a former enlisted Sgt. I agree with you that the officers only think they run the military. And another point is that the enlisted outnumber the officers. I am afraid that it is rapidly getting to the point where a peaceful end to this problem is not going to be possible.
Our (non) representatives still have a chance to correct the direction of this country if they have the guts to stand up and be counted. If not, then I believe the military, not the officer corps, will be necessary. I pray not.
