Yet Another Modest (Somewhat) Proposal

(Jun. 1, 2026) — OK, faithful P&E readers, buckle up for yet one more modest (as modified in the title, “somewhat”) proposal.  Over the years, your humble servant has offered several proposals aimed at addressing the anomalies and conundrums affecting the body politic.  Thus far, none have been adopted.

That said, however, the following proposal, in your servant’s opinion, is one which President Trump and the GOP should take seriously, because the Democrats – and Democrat politicians now still in office – are deadly serious about their plans to continue undermining the President and his efforts to return the Republic to status as the “shining city on a hill” described by President Reagan.  And for the few Democrats reading this: be careful what you wish for.

But enough of the preliminaries: let us cut to the chase.

At bottom, the proposal is that President Trump do exactly what the Democrat politicos threaten to do if – by hook, crook, unfolded mail-in ballots or other nefarious means – they ever again purloin control of the White House and the Congress.  They propose to “pack” the Supreme Court with at least four more Justices who they think will dance to the Democrat Party tune.

That toxic tango, of course, is to continue the transformation initiated by Monsieur Obama of the Republic into a fourth-world landfill the Founders would be unable to recognize.  Stated otherwise, they hate America and all that it stands for.  Oh, and they hate President Trump and you as well.

Think of it, faithful reader: with Democrats back in control of 1600 and the Congress, we could theoretically have a 13-member Supreme Court, with four more Justices coughing up stellar intellectual nuggets rivaling those of Justice Ketanji Brown Jackson …, chew on that bitter-sour stick of gum for a moment.  Urgh ….

Accordingly, while he still has the chance, 47 should now consider adding – with the cooperation (keeping fingers crossed) of a GOP-controlled (for the moment) Congress – two (not four) additional seats to the Court.  This would fall short of “packing” the Court, but would simply be an expansion to accommodate the growing docket load of cases and the burgeoning needs of an increasingly litigious nation, thanks in no small part to the penchant of Democrats to engage in endless, frivolous lawfare.

But now for the “somewhat” zinger (buckle up): the leading candidates to become the two new Justices should be Senator Ted Cruz and Secretary of State Marco Rubio.  Both are excellent lawyers, and their conservative bona fides would be surely acknowledged by the Senate in their confirmation hearings.  Translation: their confirmation could come quickly and without the lunatic opposition of Democrat senators seen in the recent past in other confirmation hearings…, again, with fingers crossed.

This proposal, moreover, would have the obvious added benefit of seating two more conservative Justices on the Court before Justices Samuel Alito and Clarence Thomas either retire or head for that Great Courtroom in the Sky.  And this doesn’t even reach the ecstasy of driving a dagger through the heart of any future Democrat effort to “pack” the Court in the highly unlikely event that, by hook, crook or other nefarious means, they regained power.  Again, think of the bitter-sour gum analogy mentioned earlier.  Can the nation survive four more Jacksons on the Court?  Hint: a hard “no.”

And as for the question of any aspirations that Messrs. Cruz and Rubio may have for the presidency themselves, for the good of the Republic, they should understand and accept that those desires are (or should be) subordinated to fortifying the Supreme Court against the scurrilous and politically-motivated assault upon it by the Democrats.

Moreover, as your servant has posited in the past, while both Mr. Cruz and Mr. Rubio would honor the Supreme Court with their presence on that bench, it is highly unlikely that either one is a “natural born Citizen” under the Constitution’s “Eligibility Clause,” and thus both are likely ineligible to the presidency or vice-presidency in any event.

Rest assured, if either one of them were to seek either office, the Democrats would howl about the nbC eligibility issue as to both.  On the other hand, one does not need to be an nbC to be on the Supreme Court.

Thus, this proposal would eviscerate that potential and, to boot, would add to the Court two “young” conservatives (both Rubio and Cruz are but a spry 55) who would serve out lifetime appointments protecting the rule of law and the survival of the Republic.  Presidents are normally limited to eight years in office.  The term “normally” is used in recognition that, under certain scenarios, 47 could actually serve longer…, but that topic is for another time and offering.

Memo in closing to thoughtful P&E readers:  Is this proposal far enough “outside the box” to merit additional examination by 47?  It will never get airborne if the attempt is never made, so what is the downside?  The apoplectic stroke the Democrats would suffer would alone be worth the effort.  Thoughts?
