(Mar. 16, 2026) — At the request of several medical organizations seeking an injunction on the Advisory Committee on Immunization Practices’ (ACIP) scheduled meeting on Wednesday and Thursday of this week in a lawsuit against the Department of Health and Human Services (HHS), Children’s Health Defense (CHD), founded by current HHS Secretary Robert F. Kennedy, Jr., reported later Monday that U.S. District Judge Brian E. Murphy ordered a stay on the meeting as well as future scheduled ACIP meetings.
In January ACIP made changes to its recommendations to the CDC for childhood vaccinations, a schedule often adopted by school systems nationwide.
In the conclusion of his opinion issued Monday, Murphy wrote:
(i) The Court STAYS the January 2026 Memo revising the CDC’s childhood immunization schedule pursuant to 5 U.S.C. § 705.
(ii) The Court STAYS the appointments of the thirteen ACIP members appointed on June
11, 2025, September 11, 2025, and January 13, 2026.
(iii) The Court further STAYS all votes taken by the now-stayed ACIP.
The Post & Email reported earlier on the meeting, which in an unusual development was rescheduled from February. The committee was to discuss the topic of “Post-Acute Covid-19 Vaccination Syndrome (PACVS), according to medical journalist Maryanne Demasi writing at Brownstone Institute.
In a Substack column titled, “Rogue Judge Strikes Again,” ACIP member Dr. Robert W. Malone wrote, “For the second time in less than a year, U.S. District Judge Brian E. Murphy of Boston has inserted himself between the elected executive branch and its constitutional authority to govern, issuing a sweeping injunction Monday that blocks Health and Human Services Secretary Robert F. Kennedy Jr. from implementing common-sense reforms to the nation’s childhood vaccine advisory structure. The ruling, which freezes both a revised immunization schedule and Kennedy’s reconstitution of the Advisory Committee on Immunization Practices, is the latest episode in a troubling pattern: a midnight Biden appointee wielding judicial power as a political weapon against a duly elected administration.”
