(Jun. 22, 2021) — The petitioner in a case filed with two lower federal courts followed by the U.S. Supreme Court contending that Kamala Harris is not constitutionally eligible to serve as vice president or president has acquired what he describes as “certified copies” of documents from the National Archives showing that Harris’s father, Donald Jasper Harris, naturalized as a U.S. citizen in September 1981, nearly 17 years after Kamala’s birth in Oakland, CA.
In 1961, Jamaican-born Donald Harris arrived in the United States on a student visa designated as an “Issa Scholar,” after which he earned a Ph.D. in economics in 1966 and went on to teach at four American universities, the last being Stanford University.
He would remain at Stanford for the next 26 years, retiring in 1998 “in order to pursue more actively and practically his long-standing interest, which originally motivated him to take up the study of economics, in developing public policies to promote economic growth and advance social equity,” according to his Stanford biography.
In November 2010, Donald Harris was declared an adviser to the Jamaican government on economic growth as the world struggled to recover from a severe recession initiated by the collapse of the U.S. housing market and other factors. “Throughout his career he has had a continuing engagement with work on the economy of Jamaica, his native country,” his bio reads. “He served there, at various times, as economic consultant to the Government of Jamaica and as economic adviser to successive Prime Ministers.”
Laity has contended that no individual born to foreign-citizen parents, even if the birth takes place in the United States, qualifies for the presidency or vice-presidency for failure to meet the “natural born Citizen” requirement set forth in Article II, Section 1, clause 5 of the U.S. Constitution. A statement appearing in the Congressional Globe, which later became the Congressional Record, by Rep. John Bingham, considered the author of the 14th Amendment, supports that definition of the term the Framers reserved solely for the president and commander-in-chief.
Dissenting opinions say that anyone born on U.S. soil, regardless of the citizenship of the parents, is a “natural born Citizen” eligible for the presidency or vice-presidency.
Kamala Harris’s mother, Shyamala Gopalan, was a citizen of India when she arrived in the U.S. in the fall of 1959 as a Master’s degree student. It is unclear whether or not she naturalized as a U.S. citizen before her death in 2008.
Donald Harris’s naturalization application was filed under the Immigration and Naturalization Act’s Section 316(a), which requires that the applicant have been “lawfully admitted” to the U.S. as a permanent resident, met the residency requirement, and demonstrated that he or she “is a person of good moral character, attached to the principles of the Constitution of the United States, and well disposed to the good order and happiness of the United States.”
Knowledge of American civics and the English language were required for citizenship in 1981.
At the time, the Immigration and Naturalization Services (INS) was a subsidiary of the U.S. Department of Justice.
As was discussed by then-Chapman University Professor of Law John Eastman prior to the 2020 presidential election, some decades ago, children born in the United States to non-U.S. citizens were not always considered U.S. citizens.
Kamala Harris’s presumed U.S. citizenship, Eastman wrote, could have been in question stemming from her parents’ status:
If neither was ever naturalized, or at least not naturalized before Harris’ 16th birthday (which would have allowed her to obtain citizenship derived from their naturalization under the immigration law, at the time), then she would have had to become naturalized herself in order to be a citizen. That does not appear to have ever happened, yet without it, she could not have been “nine Years a Citizen of the United States” before her election to the U.S. Senate.

No judge who heard an eligibility challenge on the merits ruled there’s a jus sanguinis requirements for those born in the United States to be natural-born citizens. These judges have made clear there is no such requirement for those born in the United States.

We have been dealing with the far-left slow-roll strategy of Antonio Gramsci to bring down the western democracies including the USA for a long time. Key institutions have been infiltrated and controlled by the far-left organic intellectuals and permanent persuaders, as Gramsci called them, under the Marxist plan which Gramsican gradualists call “The Long March Through the Institutions.” They’ve been at it for generations for the last 100 years and are at the apex of their hegemony in the institutions and thus control virtually all of our national institutions. If Trump had not won the election they would have come forward and out of the woodwork and totally taken over under Clinton and moved the nation at a quicker pace to a Socialist one, which status to the Communists is a temporary state, and just one more step towards Communism, which end state they believe is a Utopian form of government. The article excerpted and linked to above by Jeff Carlson is spot-on about Gramsci and a good summary of Gramsci’s long-term political agenda to bring socialism and communism to the western democratic nations. Modern “Progressives” believe in and use his tactics and strategy all the time. And they know what they are “progressing” towards … Socialism … and then in the very long-term Communism.
Learn what Jeff Carlson is sharing in his article and spread it to your friends and associates and anyone and everyone who needs to learn that what we see is happening in our country, and the co-opting and destruction of our institutions and changing the meaning of words in our language, is not an accident. Gramsci was educated as a linguist. He advocated the manipulation of language to further political goals. What we are experiencing is the result of the Gramscian long-term plan all along. We are just the generation at the end point of his long-march strategy in which we see it coming to full fruition and a head.
What we are feeling and seeing now, that we know something is wrong in our country, we can all now understand that it has has a name “Gramscism”. It’s “progress” must be stopped before it is too late. Control of the the House and Senate must be taken away in 2022 from the Democratic Socialist Party lead by Pelosi and her ilk. President Donald Trump must be re-elected in 2024. They tried to cripple him in his first term at every step. Now he knows what he’s up against. He will be the only one with enough power, authority, and courage to take them on if he gets a second term. Give him the opportunity to save our constitutional republic. The U.S. Supreme Court has docketed Laity’s petition for rehearing.
Given the press of other business, it is very unlikely it will on this term’s final conference. Leaving the inevitable denial to happen at the fall’s long conference.
The “dissenters” who “say that anyone born on U.S. soil, regardless of the citizenship of the parents, is a ‘natural born Citizen’ eligible for the presidency or vice-presidency,” includes the judges who heard eligibility challenges.
Regardless, there is no dispute that Donald Harris was not a U.S. citizen when his children were born.
Neither Donald Harris or his wife were US Citizens at the time of the birth of their daughter Kamala.
That means that Kamala Harris is NOT a “Natural Born Citizen” of the United States. She has failed to meet the Jus Sanquinis requirement (of the Blood of Americans) in the definition “One born in the US” (Jus soli or of the soil of the US) IN ADDITION TO the requirement of being born of two US Citizen Parents (Jus Sanguinis or of the blood of Americans).
No one disputes that neither of Harris’ parents were U.S. citizens at the time of birth. So obtaining her father’s naturalization documents doesn’t shed light on anything.
According to “dissenters,” i.e., actual judges who heard eligibility challenges, for those born in the United States, jus sanguinis is irrelevant to being a natural-born citizen.
IF – everyone born on U.S.A. soil or anyone born outside of the U.S.A. to at least one U.S.A. citizen parent IS considered a natural born Citizen, then why aren’t the words “natural born” prefixed to the word “citizen” in all of the U.S.A. citizenship and naturalization laws where the above applies? Just asking for a friend. LOL (Liberal On LSD).
