FORT BRAGG, N.C. – Army Judge Col. Jeffery R. Nance conducted an Article 39(a) Motions Hearing May 5 on Fort Bragg, N.C., in the case of United States vs. Sgt. Robert B. Bergdahl.

The May 5, 2017, Friday, military legal hearing convened at 9:58 a.m. and adjourned at 12:50 p.m. Trial counsel present were: Maj. Justin C. Oshana with assistant trial counsel Maj. Jerrod Fussnecker and Capt. Eileen Whipple. Defense counsel present were: Lt. Col. Franklin D. Rosenblatt with assistant defense counsel Maj. Jason Thomas, Maj. Oren Gleich and 1st Lt. Lorena Marez.

The hearing updated the government’s current status to provide unclassified and classified government documents requested by Sgt. Bergdahl’s defense lawyers, and the progress by defense counsel to review those documents.

The hearing also discussed several motions by defense counsel associated with access to classified information, production of documents, and the protection of information designated as “For Official Use Only” by the government.

No witnesses testified at this hearing.

The next legal-motions hearing date currently is scheduled for June 21. The trial currently is scheduled for Oct. 23, 2017, on Fort Bragg, N.C. The voir dire process for potential military panel members – known as jurors in civilian legal proceedings — currently is scheduled for Oct. 16 – 20, 2017.

Bergdahl was promoted since he’s innocent until convicted by a court of law. It may be difficult prosecuting him since Pres Trump & Sen McCain made derogatory statements about him creating undue command influence making prosecution difficult or perhaps impossible…. If he’s found innocent he could walk with $250,000!! What would McCain & Trump do then?

Sgt Bergdahl was released from the Coast Guard when he couldn’t perform due to a mental disability.. The US Army was undeterred & enlisted him despite his mental condition. The US Army then put a mentally defective man in a position where other lives were at risk if he did not perform..The US Army knew that they had a mental defective in their ranks & put others in harms way when they used him for combat.. Sgt Bergdahl cracked & went on a fools errand into enemy territory where he could have been killed.. Now the US Army wants to punish a mental defective when they are clearly at fault & put others at risk..Pres Trump denounced Bergdahl many times so that Bergdahl cannot get a fair trial. The prosecution & the judge depend on Trump for promotion so if they don’t convict they’re in trouble.Sen McCain also called for an investigation if he’s not convicted.. The US Army should prosecute the guy that enlisted Bergdahl. & everyone who thought this guy was OK for combat…The Army needs canon fodder so they’ll take anyone for combat duty , mental defects & criminals..Who cares how many will die…They’re useless anyway….

I myself as a junior enlisted Marine can’t recall when an enlisted fellow Marine was under Military Justice it would have taken as long as in the Bergdahl Case. From what I can recall, when a Marine was about to be charged, he was put on base restriction, or restricted to the barracks.

I also can’t understand that additionally that when Berghahl came back to the states, he was
promoted.

Overseas, he avoided and neglected to use the “Chain of Command” and proper
grievance procedures. Further, when I served in 80 to 89 another source of assistance was
the unit Chaplin. So, Berghahl had at least a handful of options to state his case.

His so-called stated reasons to leave his base makes no sense to me. From what I have learned on Berghal’s case he went off logic and common sense. He left his base for
reasons that make no sense, put his fellow soldiers at risk, leading to some to lose their
lives.

Obama’s statements and his administration (Susan Rice) made him seem like a hero.
How did they get this so wrong? This is “Barry’s Baby”.

This is a sad event that no one wins. Let’s continue to remember the families of the soldiers in
prayer who gave their lives searching for Berghal, for him, and all family members affected.
