FORT BRAGG, N.C. – Army Judge Col. Jeffery R. Nance conducted an Article 39(a) Motions Hearing Nov. 14 on Fort Bragg, N.C., in the case of United States vs. Sgt. Robert B. Bergdahl.

The Nov. 14, 2016, military legal hearing convened at 9:01 a.m. and recessed at 2:39 p.m. Nov. 14 until Tuesday morning, Nov. 15, at 9 a.m. Trial counsel present were Maj. Justin C. Oshana with assistant trial counsel Maj. Jerrod Fussnecker and Capt. Eileen Whipple. Defense counsel present were Mr. Eugene Fidell and Lt. Col. Franklin D. Rosenblatt, with assistant defense counsel Maj. Jason Thomas, and Maj. Oren Gleich.

The military judge discussed with both legal counsel a number of recent and pending motions. Motions and discussions included: a government motion for continuance dealing with the government’s efforts to provide defense counsel with classified documents and a proposed continuance date for the court-martial proceeding; defense efforts to obtain document-handling software and hardware for classified records; and witnesses involved in the 2009 search for Bergdahl in Afghanistan.

Witnesses who testified during the legal proceeding include: Army employee Timothy Mersereau, who spoke briefly about government-security procedures and classified control measures; Army Col. (Ret.) Robert Campbell, the former commander of the 1st Squadron, 40th Cavalry, 4th Brigade, 25th Infantry Division, from Fort Wainwright, Alaska, who spoke about the 2009 search in Paktika Province, Afghanistan, for Bergdahl. Air Force Maj. John Marx also spoke about the search efforts following Bergdahl’s June 30, 2009, disappearance. Following the lunch recess, Army Staff Sgt. Jason Walters testified in person about the 2009 search; telephone testimony by Army Col. Peter Minalga about the search; and former Army specialist Mr. Jonathan Morita, who also spoke in the courtroom about the search.

Following tomorrow’s Nov. 15 Tuesday hearing, the next legal-motions hearing currently is scheduled for Dec. 1, 2016 on Fort Bragg, N.C. The trial is now scheduled for May 15, 2017.
