OR IS IT UP TO “WE THE PEOPLE?”
by Sharon Rondeau
(Oct. 2, 2014) — Among several recent reports that Sen. Ted Cruz of Texas is considering or plans to run for the presidency in 2016, The Post & Email visited the website of the Republican National Committee (RNC) seeking comment from a press representative regarding Cruz’s constitutional eligibility.
Upon searching the website, we found a “2016 Presidential Straw Poll” listing the names of Cruz, Louisiana Gov. Bobby Jindal, and South Carolina Gov. Nikki Haley as possible candidates, among many others.
The Post & Email called the contact number provided, 202-863-8500. An intern answered the call; we informed her that we are a media outlet seeking comment on a constitutional question. She listened to our question, which, referring to Cruz, was, “How can a man born in Canada to a Cuban-citizen father be considered a ‘natural born Citizen?'” We then recited the first section of Article II, Section 1, clause 5 of the U.S. Constitution, which states:
No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.
The intern listened courteously and stated that she would have someone authorized to speak to the press respond to our inquiry by phone or email on Thursday.
The RNC Platform states that the “Constitution should be honored, valued and upheld,” but Republicans have thus far refused to address the questionable eligibility of Barack Hussein Obama, who claims a Kenyan father and birth in Hawaii to a U.S.-citizen mother. A criminal investigation conducted by the Maricopa County, AZ Cold Case Posse determined two and a half years ago that Obama’s long-form birth certificate, posted on the White House website on April 27, 2011, and the Selective Service registration form mailed by the Selective Service System to various FOIA requesters, are “computer-generated forgeries.”

The Post & Email raised the matter of the Cold Case Posse’s investigation with the intern and was directed to the RNC comment line at 202-863-8600, where any citizen can leave comments they wish the RNC to review. Other comments she made are not authorized for publication.
During the conversation, The Post & Email posed the possibility that Cruz was never eligible to serve as a U.S. Senator, as he was born with Canadian citizenship and has shown no proof that he was automatically granted U.S. citizenship through his U.S.-citizen mother at the time of his birth. On June 7 of this year, JB Williams claimed that it appeared Cruz was not eligible to serve as a U.S. senator when he stated that “Ted Cruz was not registered at birth as a citizen of the United States. His only existing birth record is his Canadian birth records.”
After speaking with the RNC intern, The Post & Email contacted Sen. Cruz’s press office by email:
PRESS INQUIRY – SENATORIAL/PRESIDENTIAL ELIGIBILITY
As you know, there have been many questions about the constitutional eligibility of Barack Hussein Obama given that he was reportedly born to a foreign-citizen father.
Whether or not Obama was born in Hawaii as he claims is not proven since a criminal investigation has determined that the long-form birth certificate posted on the White House website and his Selective Service registration form are “computer-generated forgeries,” both federal felonies.
The lead investigator has now stated publicly that he knows who the forger is, a matter which Congress has been unwilling to investigate on its own.
Last December, Sen. Cruz was sent a letter asking him to examine his own conflicts with the “natural born Citizen” clause of the U.S. Constitution in the event he chose to run for president. To my knowledge and others’, Sen. Cruz did not respond to the letter generated by the North American Law Center (NALC).
The letter stated, in part:
Senator Cruz, you have been placed in the position to end the greatest fraud ever perpetrated on the United States of America, and to stop the systematic destruction of our Country. The action required is simple – but not easy, for it requires a selfless act of love and concern for others, and calls upon you to do the right thing. Yes, some will call it a true act of heroism.
The wording in Article II, Section 1, clause 5 raised the presidential requirement to “natural born Citizen” from simply “Citizen,” as the Framers had first written before John Jay interjected, “Permit me to hint whether it would not be wise and seasonable to provide a strong check to the admission of foreigners into the administration of our national government ; and to declare expressly that the command in chief of the American army shall not be given to, nor devolve on any but a natural born citizen.”
With a birth in Canada to a Cuban-citizen father, how does Sen. Cruz qualify as a “natural born Citizen” of the United States, even with the renouncing of his Canadian citizenship earlier this year?
Additionally, in an editorial dated June 7, 2014 writer JB Williams stated that Sen. Cruz was not born with even dual American-Canadian citizenship and might therefore not qualify even as a U.S. Senator:
The constitutional requirement for U.S. Senators reads:
No Person shall be a Senator who shall not have attained to the Age of thirty Years, and been nine Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State for which he shall be chosen.
Was Sen. Cruz naturalized or born with dual Canadian-American citizenship? Does he possess proof of U.S. citizenship?
If he was naturalized, it would appear that he would not meet the definition of “natural born Citizen” as most Americans understand it, as it would place him in the same category as Arnold Schwarzenegger.
Is Sen. Cruz willing to issue additional documentation showing how he qualifies either as a U.S. Senator or prospective presidential candidate?
Thank you very much.
