AS EXCEPTION TO “FREEDOM FROM UNWARRANTED SURVEILLANCE”
(Apr. 3, 2013) — If we do not stand for Liberty, who will? If we will not stand now, when will we stand. The federal government is destroying our Constitution every day and eliminating our protection of Liberty. Yet, even our STATES are giving the FEDs permission to do this.
The following is an URGENT LIBERTY ALERT regarding a Florida law to limit drones but granting broad and unconstitutional EXCEPTIONS for the federal government. We must REMOVE these exceptions!

URGENT! FLORIDA ALERT: The Florida Senate has placed SB92-“Freedom from Unwarranted Surveillance Act on the Special Order Calendar, 04/04/13″…This might seem like a good bill and has the potential to be one,
HOWEVER…this bill contains an EXCEPTION that will negate the entire purpose of the bill and actually GIVE PERMISSION to DHS to use drones over Florida in violation of the 4th Amendment. Here is the text that MUST BE REMOVED!
(4) EXCEPTIONS.-This act does not prohibit the use of a drone:
(a) To counter a high risk of a terrorist attack by a specific individual or organization if the United State Secretary of Homeland Security determines that credible intelligence indicates that there is such a risk.
“Credible evidence” IS NOT probable cause, the standard established by the 4th Amendment and the standard required of State law enforcement use of drones.
What exactly is a “risk”? What are the parameters of a “risk”? When does something move from being a “suspicion” to a “risk” and who determines that?
Since the State is giving open permission to the Feds to use drones, WHAT mechanism is established in this act to allow the State to check this federal power? How did the State retain its power to tell DHS they cannot use drones if this power is being abused?
This exception creates a Constitutional black hole that will allow the FEDERAL government the right to violate our 4th Amendment and this legislation will give them the permission to do it.
