Looks Like Bill Owens' Campaign orchestrated Election Fraud in NY-23

IMPOUNDMENT ORDER SOUGHT BY OWENS’ CAMPAIGN ENABLED HIS HOUSE APPOINTMENT

(Nov. 16, 2009:  3:40 AM ET) — Even before a single vote was cast in the special election in the New York State 23rd Congressional District, the Times Union and Associated Press were reporting warning signs that might mar the credibility of the vote count.

Pre-Election warnings foretold widespread problems

Rick Karlin, of the Capital Bureau at the Times Union of Albany, New York, reported on Oct. 29th, that:

But Tuesday’s vote will also mark one of the first large-scale uses of the state’s new digital devices, part of the long-awaited move from decades-old mechanical lever voting technology.

Of the 11 counties in the 23rd, seven will be using paper ballot/optical scanning voting systems rather than the lever machines, said John Conklin, spokesman for the state Board of Elections. Two counties will combine old and new systems, while another two — Clinton and Essex — are keeping lever machines.

Clinton and Essex counties are the 2 counties of the NY-23 district which border Vermont.  See the excellent map of the district at the TCOT Report.

And further down in the article, he likewise reported that the AP was saying that the Democrats somehow knew to expect Election Fraud:

In a related matter, the Associated Press reports Democrats are heading to court seeking to have voting machines impounded on election night. Democrats say they’re going to court early because a portion of the district is requiring people who registered to vote in time for federal elections, but not in time for state and local elections, to vote on ballots — not on the pull-lever machines.

Impounding voting machines election night, would seem to be one method for enabling friendly law enforcement personnel to ensure that any voter fraud committed, would be concealed and protected, so that independent groups could not inspect what happened.

Election-Night Irregularities

In the unofficial tally of votes in Madison County — published by the TCOT report — Hoffman received no votes in precincts in the towns of Fenner, Hamilton, Sullivan.  In Fenner and Sullivan, it appears that Hoffman’s votes were given to Scozzafava. It is not know whether these precincts were using the old lever-balloting systems or the new electronic scanning systems.  It should be noted that even in the electronic scanning systems, it is very easy to perpetrate voter fraud by tampering with the machinery or submitting duplicate ballots.

Impoundment Order sought by Owens’ Campaign used to his advantage

Nathan Barker of the Gouverneur Times reported just 50 minutes ago, that it was Bill Owens’ campaign which sought to have the voting machines impounded on Nov. 2nd, out of allegations of possible voter fraud, thus establishing cause and giving reasonable motive why Nancy Pelosi should not have seated Owens in the House.

The Owens’ campaign obtained an impound order, and kept the results under lock and key, until Hoffman conceded the race.  Only then did the Owens campaign release the impound order and allow the alleged initial vote count to support his claim to be victor. Nathan Barker writes:

The Clerk of the House of Representatives requested results of the election from the NYS Board of Elections.  The NY Board of Elections could not release those results while the vote was impounded but after Mr. Hoffman’s concession of the election, based on erroneous information Hoffman had received with regard to the vote count, the Owens’ Campaign released their impound order.  This put the Board of Elections in a position where they could report the vote count to the Clerk of the House, although they emphasized that the results were unofficial and that they could not certify the result.

Indeed, Nathan Barker of the Gouveneur Times just reported in a second article, 10 minutes ago, that this impounding order and the effect of preventing the U.S. House clerk knowing the actual election results on the day of the election, until such time as Hoffman conceded:

The Clerk of the House of Representatives requested results of the election from the NYS Board of Elections.  The NY Board of Elections could not release those results while the vote was impounded but after Mr. Hoffman’s concession of the election, based on erroneous information Hoffman had received with regard to the vote count, the Owens’ Campaign released their impound order.  This put the Board of Elections in a position where they could report the vote count to the Clerk of the House, although they emphasized that the results were unofficial and that they could not certify the result.

Irregularities were caused by human intervention

Barker in another article posted just 45 minutes ago, explains the voting irregularities:

Several errors were made during the initial vote counts.  Over 2,000 votes for contender Doug Hoffman were not counted in the preliminary results, narrowing the current vote gap to less than 3,000 votes between Democrat Bill Owens and Conservative Doug Hoffman.

The errors were discovered during the standard vote recanvas that has been underway since November 4th.  The largest error occurred in Oswego County where the vote recanvas found a discrepancy of more than 1,200 votes in Doug Hoffman’s favor.  Another error, in Jefferson County contributed an additional 700 votes in Hoffman’s favor during the recount.

The election was close enough even on election night that the New York State Board of Elections was unable to present a “clear decision” in the race according to John Conklin, Communications Director for the department.  He said that the Board sent a letter to the Clerk of the House of Representatives in Washington indicating that they could not yet determine a winner and could therefore not certify the election until after the recanvas and absentee ballot count.  Those final numbers will not be available until at least mid-December.

It certainly looks like the Owens campaign had foreknowledge of the Election Fraud and took steps to use it to their advantage.  This combination of actions and results should be sufficient to submit criminal complaints alleging conspiracy to commit and profit from Election Fraud, even if Owens would have otherwise won the race.

Hoffman’s Chance of Winning

Jude Seymour of the Watertown Daily Times, reported early this morning, also, that Hoffman does have a mathematical chance of winning, though it will be very difficult:

At the low point of her support during her active campaign, a Siena Research Institute poll released the day Ms. Scozzafava suspended her run suggested she had support from 20 percent of voters. If Ms. Scozzafava takes 20 percent of the absentee vote, Mr. Owens will need just 1,282 votes, or 18 percent, to hold off Mr. Hoffman.

The gap between Mr. Owens and Mr. Hoffman has shrunk by 2,159 since election night, after Oswego and Jefferson elections commissioners discovered human error had led to inaccurate reporting of results.

Seymour also indicated that the errors in vote counts on the night of the election were all the result of human intervention:

Sean M. Hennessey, Jefferson County Democratic elections commissioner, said poll inspectors in four districts reported Mr. Hoffman had received zero votes after inadvertently reading the wrong line of the poll system’s printout. The commissioner said results in some other districts were either incorrectly relayed by the poll worker or incorrectly typed by the part-time staff answering phones at the county department.

“The machines were not at fault,” said Jerry O. Eaton, county Republican elections commissioner. “It’s all human error that happens every election.”

Hundreds of Military Voters Disenfranchised

And it appears the election laws in New York all but guaranteed that 550 military voters, in a county which voted heavily in favor of Hoffman, were disenfranchised:

Absentee ballots from military personnel that arrive at local boards of elections by Monday will still be counted, provided they were postmarked on or before Election Day. But Mr. Eaton said the trickle of ballots to the Jefferson elections office has dried up. The county has the district’s largest military population because of Fort Drum. The elections office sent out 605 absentee ballots to military, but only 51 have returned so far.

    Is it any surprise to anyone that Obama is bringing Chicago mafia tactics on a national level? That is been going on for sometime with the Democrat party now controlled my Marxists – one just has to open their eyes to see the truth.

    Never believe what a politician says – they are for the most part – all liars. What issues do you care most about? Look at what the candidate has voted in the past, that is exactly how they will continue to vote in the future. T

    Thanks, Mr. Charlton, for the info on Democrat election machinations in NY-23, but I question your statement that “. . . even in the electronic scanning systems, it is very easy to perpetrate voter fraud by tampering with the machinery or submitting duplicate ballots.”

    Where I vote we use a felt-tip marker provided in the booth to mark a paper ballot that is then optically scanned. I don’t see how it would be easy to tamper with the scanner or to submit duplicate ballots. And, unlike computer voting, these ballots could be readily recounted by hand.

    In any case, Nancy Pelosi has shown once again that she will certify her people for office whether they really qualify or not. Fraudulent elections are her specialty.
