The Bill of Rights was written and ratified prior to the U.S. Constitution, as the Founders wanted guarantees of personal liberty, freedom of expression, and grand jury review of evidence prior to charging a citizen with a crime. Since the beginning of the post-World War II era, however, grand juries as independent investigative bodies have been diminished by Congress, judges and magistrates across the country, transforming them into tools of government rather than protection against it.
