Why Treason Charge Against Obama was Filed More than Two Years Ago

“A FOREIGN-BORN DOMESTIC ENEMY”

(May 22, 2011) — On March 17, 2009, the first criminal complaint accusing Barack Hussein Obama of treason was filed by Walter Francis Fitzpatrick, III with the U.S. Attorney in the Eastern District of Tennessee, Russell Dedrick.  The complaint cited the events of March 10, 2009, wherein U.S. Army troops were sent to the town of Samson, AL to act as law enforcement officers in violation of the Posse Comitatus Act.

The complaint did not specifically raise the constitutional eligibility question on which many bloggers and news agencies had begun to report since mid-2008, but rather, named Obama as a “foreign born domestic enemy.”  Fitzpatrick renewed the complaint on March 17 of this year with the new Obama-appointed U.S. Attorney for his district, William C. Killian, who has the ability to place it in front of two federal grand juries sitting in Knoxville, TN.

In light of the recent statements of Dr. Jerome Corsi that Obama was born in Kenya, The Post & Email asked LCDR Fitzpatrick how he knew in March 2009 that Obama had been born outside of the country.

MRS. RONDEAU: When you filed the criminal complaint, how did you know that Obama was a “foreign-born domestic enemy?”

LCDR FITZPATRICK: It would have been late 2008 and early 2009.  It was a combination of things that Sergeant of Marines Timothy Joseph Harrington and I were looking at aggressively with laser-beam focus.  Leading up to the election in 2008, Tim Harrington and I plus others, chiefly among them, Atty. Phil Berg and Atty. Orly Taitz, were trying to find out what this man’s pedigree was, what his heritage was; whether he was a legitimate candidate for president of the United States and commander-in-chief.

We came up with nothing.  All suspicions went to Mr. Obama as having been born in Mombasa, Kenya.

The election came on the 4th.  Because we had been unsuccessful in any other way to get this information publicly presented and viewed, the same letter was sent to Mr. Richard Cheney, who, at the time, was the Vice President of the United States, but at the same time presided over the counting of the electoral votes submitted by the Electoral College by the joint session of Congress.  A letter was sent to him from the top down, and a letter was sent from the bottom up, through my Elections Commissions officials here in the state of Tennessee, starting right here in Monroe County.

The letters were mailed by certified mail; they were faxed in.  I had conversations with the State of Tennessee Elections Commission representative which culminated in a demand from the bottom up and from the top down, representing myself as a citizen of the United States and retired Naval officer, for the Electors to make available the documents that they were to use individually, in each of the 50 states, and then in the District of Columbia, were to be made available at the time that Cheney opened up each of the envelopes from the 50 states and the District of Columbia.  We asked that they make them available so that we would all know what they used to determine Mr. Obama’s eligibility.  We have the proof of mailing and the fax receipts as well as conversations that I had with the elections officials here in my state.

Neither Tim Harrington nor I received any responses.  This was two days after the election.

Then information started to come out in an unguarded way from reliable sources that Mr. Obama was born in Mombasa, Kenya.  One of them was a report from the time when Obama was elected to the U.S. Senate.  It was the “The Standard” online newspaper that referred to him as “Kenyan-born.”  These are the notes I used to prepare for my interview on Dr. Manning’s radio show a couple of weeks ago.  This was an unguarded report in the day, unchallenged and from credible sources, that Mr. Obama was born in Mombasa.  There was a celebration, if you will, of the fact that his foreign birth was a unique event for someone holding office as a U.S. Senator in one of the 50 states of the United States.

Editor’s Note: On June 27, 2004, the Nigerian Observer had also identified Obama as having been born in Kenya.  Obama has stated himself that “being an American is not a matter of blood or birth.”

Within days of the election, a radio talk show contacted the Kenyan ambassador to the United States, Peter Ogego, and he said, yes, the guy was born in Kenya.  ‘It’s already well-known.'”  Again, an unguarded, reliable source; this is the Kenyan ambassador to the United States of America.  This man held a position where he would have this kind of knowledge, and in an unguarded interview, he stated it.

Then there was a thumbnail picture of a man in a Marine Corps uniform who represents himself as a former Marine.

MRS. RONDEAU: Was that “Race Bannon?”

LCDR FITZPATRICK: Yes, it was.

MRS. RONDEAU: I recently found a posting which quoted Race Bannon’s account of his meeting with someone  in Honolulu in 1980 whom he believed could have been Obama.

Did you ever have any doubt about the evidence presented by the articles or Obama’s strident insistence that he was born in Hawaii?

LCDR FITZPATRICK: No, and let me be more emphatic about what you have just asked me, because it’s something that people often don’t think about.  On the day before, and the day of, that I filed the complaint naming Obama in treason, that was not an easy thing to do. And I was prepared for a federal response which materialized two days later with the Secret Service showing up.  In typing that letter out and getting it off, it was  moment for me.  I needed to focus very clearly on what I was doing, and I needed to be very clear for myself that there was no doubt, nothing defective about that complaint.  Naming him a foreign-born domestic enemy was specifically discussed with the Secret Service when they came here on March 19, 2009.  In fact, that was the moment at which the tension broke favorably, and it became a more amiable, friendly kind of a meeting.  I remember this; I lived it.

For myself, I needed to be dead-certain that I was right.  Sergeant Harrington was the one who independently examined what I was looking at.  I didn’t do this by myself; I asked for his input.  I said, “Tim, if I’m walking off a plank, tell me, so that we don’t do something stupid here.”  And at every step:  “No, no, no, you’re OK.”  And as we were contacting Orly Taitz – and she will tell you this –  and Phil Berg, at the same time.  In December 2008 and January and February 2009, we were approaching them and saying to them that they could legitimately raise a criminal complaint against Mr. Obama naming him criminally in the offense of treason.  We tried to tell them both that they were barking up the wrong tree by taking on this issue in a civil suit.  I won’t pay a moment’s notice to anything that deals with a civil suit today, and I haven’t for two years now.  You’re not going to unseat Obama using a civil suit; it’s just not going to work, and it hasn’t.

So Tim and I told Berg and Taitz:  “We’ll give you first right of refusal.  We’ll give you the first opportunity to turn away from naming Obama in the commission of treason.”  It was in late January/early February, as I recall, that Tim and decided on a date when we were going to act.  We said, “If Berg and Taitz don’t pick this thing up by this date, we’re going to act.”  And as we got closer and closer to that date and nobody – it wasn’t just Berg and Taitz; I forget who the other players were, but it’s not important – you get the sense that we gave people who had “skin in the game” a chance.  We weren’t trying to upstage anybody; we weren’t trying to do this for any kind of promotional reasons; we weren’t trying to sell a book; we weren’t trying to do this for a gimmick.  We were dead-set serious on this, and as the days passed, Tim and I had other confirmations come in even after we had already been dead certain.

So we got to the 15th or 16th of March, and at that time, I didn’t have a computer at home.  I had to go to the Sweetwater Library and type the complaint out.  I remember working with Josh Franks, the librarian.  I went in early and had an hour on the computer; then it had to be shut down, and any work that you had there would be lost if I hadn’t printed it off.  So I asked Josh that day if he would extend my time at the Sweetwater Library computers.  I was going fast and was stressed on this…I misspelled “criminal” in the subject line, and people were throwing rocks at me for that, and I thought, “Go away; leave me alone.”

I typed it up on the 16th, dated it for the 17th, and it was the next morning that I had it notarized and mailed it off.  On that day, I was absolutely dead certain that Obama was born in Mombasa, Kenya.  There was absolutely no question in my mind.

Since that complaint has been filed, I have said over and over again, and as recently as to Dr. Manning, either on air or in conversations with his wife and him off the air, that I stand to be arrested if that complaint is defective.  And it’s been refiled since, this year, on March 17th.  That was the date that Tim and I set.  Why would you think that two Irishmen would pick the 17th of March as the date that we would launch this complaint?  Well, because March 17 is St. Patrick’s Day.  We were excoriated for that for a while, although not so much anymore.

MRS. RONDEAU: And then you said that two days later…

LCDR FITZPATRICK: It was on the 19th of March, and I was out on my front lawn with my telephone in my hand, and I was talking to Tim Harrington when the Secret Service drove up with two police escorts in Sweetwater Police patrol cars. I said to Tim, “I have to go.  They’re here.”  I didn’t know who “they” were, but I said, “They’re here.”  The two police cars gave up the game, and the government silver car turned out to the Secret Service with two special agents.

I have this recorded:  it was Special Agent Roland McAmos, who was senior agent in charge of the Secret Service in Knoxville.  They rode in a single vehicle; it was a dark silvery-gray van, and with him that day was Special Agent Leslie Cochran, U.S. Secret Service.

McAmos pointed to the phrase, “foreign born domestic enemy,” and asked, “Walt, what did you mean by ‘foreign born domestic enemy?'”  By this point in the conversation, I had held up my identification card as a military officer and they recognized me and were addressing me as “Commander.”  As I was talking to them, the phone in my pocket was ringing off the hook; it just kept ringing and ringing and ringing, and it was Tim!

So they asked me, “What did you mean by ‘foreign born domestic enemy?” and I remembered:  he had a copy of the letter out in front of me, and I was going to point to it, and his assistant, Leslie Cochran, jumped at me to go and grab my hand away from the piece of paper, and I said, “Back off.  I’m not a threat.  I’m not a danger to you or anybody else standing here.  Just back off.”  And she did.

Then, McAmos was pointing right at the phrase, “foreign born domestic enemy.”  I looked at him, and I looked at her, not the two police oficers; I looked at the two federal agents.  I held my left hand up and said, “You two took the same oath to the Constitution that I did, right?” and they said, “Yes, yes, we did.”  And I said, “And you don’t understand what those words mean?”

That was the instant; it was like a lightning bolt.  McAmos kind-of held his head up, rolled his eyes, turned, and went “Ewwwww.”  Cochran’s body language was relaxed, and she also went “Ewwwww.”  In our oath, we swear to defend the Constitution of the United States against all enemies, foreign and domestic.  So the choice of that language in that sentence is unique, because I use both “foreign” and “domestic,” and I add to the “foreign” the adjective “born” to make “foreign born domestic enemy.”  He’s foreign-born and he’s here as a domestic enemy.  That sentence appeared for the first time in that complaint dated 17 March 2009.

MRS. RONDEAU: Now did you say that from that point on, they kind-of relaxed or became a little less hostile?  How would you explain that?

LCDR FITZPATRICK: The moment changed, and they didn’t have many more minutes left.  I had already asked for and received Leslie Cochran’s business card.  I asked Roland McAmos for his business card, and this was at a moment in time when things were pretty “tight.”  We’ll get to that in a minute.  Then I presented my identification card, which I had in my back pocket.  At that time, I didn’t have my business cards that you now have.  I showed him that, and that’s when he recognized me as a retired Naval officer for real, and then he started asking questions about whether or not I represented a threat to Obama.

I said, “I don’t need to talk to you guys.”  He tried to loosen things up a little, but I was hostile.  I was not happy, and they all knew it.  As the conversation progressed for about 15-20 minutes, we got to the point which I have just described to you when they asked, “What do you mean about this ‘foreign born domestic enemy’ thing?”  Then, after that, it was as if they realized that I knew exactly what the heck I was talking about. They knew!

When Special Agent McAmos was leaving, he opened the trunk of his car to get me a business card and said to me, “We can’t arrest him, you know.” 

I was contacted again by the Secret Service when I went on a trip in the summer of 2009.  They were tracking me, and they still are.  I’m in their database.  I have a satellite assigned to me.

Coming back to the question about “Did I know that Obama was born in Mombasa with certainty?” Yes, I did, and it was based upon the fact that as a military officer, I had reasonably asked about what my chain of command looked like, and I was owed an answer and didn’t receive one.  Then other reports came in from when Obama ran for U.S. Senate came in unguarded, made freely, and had never been challenged.  Then there were the two sets of documents signed by Nancy Pelosi; one went to Hawaii and the other version went to the other 49 states.  The one that went to Hawaii said, “Yes, he’s eligible,” and the others didn’t address that issue.  So there was that.

So I’m thinking back to the time when I asked the Electoral College what they used to establish his eligibility, and so specifically, as it goes to Tennessee, the Electors from the state of Tennessee failed in their duties to establish Mr. Obama’s eligibility because the comparison document comes from the state of Tennessee. That goes back a year ago!  So specifically as it goes to the state of Tennessee, this is another example of treason inside the state of Tennessee for election fraud.  I am now a citizen of the state of Tennessee, and I have standing, and these things have just been ignored left and right.

Those documents came in after we were discovering the kind of problems we had with the grand juries in the state of Tennessee.  But all of these things have been unraveling one after the next after the next, all along the way.  I’ve said this over and over again:  back in the day, on the 19th of March, just before 3:00 p.m., when the Secret Service rolled up, I expected to be arrested, and I wasn’t.  I’ve been back to the FBI repeatedly, as you know; I’ve been talking to them for a couple of years now and have several contacts with them.  I said the same thing to them:  “I have not been placed under arrest.”  As a military officer raising this challenge, it has to be answered, and it has gone without an answer:  you know, “Qui tactet consentire.” He has conceded. So now today, again, I have this inarguable, unassailable proof that Mr. Obama is from Kenya, because he has accepted the charge that he is a foreign-born domestic enemy.  He has held that as acceptable to him for over two years.  And here we are talking tonight.

Now I have been arrested for other things since, and while I was in the custody of the Monroe County Sheriff’s Department, the Feds could have gotten to me and said, “Well, we’ve got ‘im locked up now; let’s go get him for this other stuff.”  That would have been a perfect time to exploit the fact that I’d been arrested.  It would have been a perfect opportunity for the Feds to exploit everything they’ve said about me, or Darren, or anybody else who’s involved in this work…Carl Swensson, the “birthers,” or you.  It would have been a perfect opportunity for them to put an end to the question of Mr. Obama’s eligibility.

In the day, it was a man-to-man assault.  Either I’m right about this, Mr. Obama, and you must leave office, or you are right about this, Mr. Obama, and you get to stay in office and you put me under arrest to prove the issue.  It was a challenge from the military. You have no choice.  Either you leave the White House or I go to Ft. Leavenworth.  And nothing happened.

You see, for him to arrest me for making that charge, he would have had to deal directly with the question of his eligibility.   In the day, I knew how incendiary this whole issue of his birthright was, and I said, “I don’t even need to touch that.  I can claim treason for another reason.” Tim Harrington and I had already decided in late January or early February that the date for our complaint of treason was going to be on the 17th of March.  And then, a week earlier, Mr. Obama sends troops illegally into Samson, AL, as I, a military officer, was watching, and knowing what kind of violation of the Constitution he has just committed.  And, Sharon, in the day, when Mr. Obama was first charged with treason because of his deployment into his deployment of troops into a civilian community, militarizing a police force, taking over the government of Samson, AL, it was just an accusation.  It needed to be proven.  If it had been brought into any kind of a criminal court, it was an accusation that had to be proven.  Well, since then, the Inspector General for the U.S. Army went back in and looked at what those troops did on 10 March 2009, and the Inspector General said, at the time, “Yes, we did violate the Constitution.  We  did infringe upon the freedoms of the civilian citizenry of Samson, AL.  Yeah, we did that.  We did violate the law here, but, so what?

So Mr. Obama’s treason, if we only had the Samson, AL event, is admitted to. Now we have so very much more about treason, and these issues are burgeoning about where the man was really born.   And we go back to the beginning, which is to say that I have always known that Mr. Obama is a foreign-born domestic enemy.  And he can be brought up on charges of treason for that.  Let me just think about it…he was brought up on a charge of treason naming him a “foreign born domestic enemy” from the military.

MRS. RONDEAU: There’s a blogger named Ulsterman who talks to someone called “White House Insider,” and White House Insider has just reportedly said we should watch for something on Eric Holder in the near future.

LCDR FITZPATRICK: Yes.  It’s a very interesting dynamic, because somebody in the chain of command within the FBI can take a stand on this and say, “Holder is as much in the tank with Obama as anybody else.”  I’ve said this before at my website when I posted the piece from Ulsterman.   You know what kind of effort I’ve tried to bring about where we get the critical mass of people, either in the military or in the FBI, or both, or in the country, to come forward and stand against this man in numbers that are so powerful that there is no other option but to act against Mr. Obama in an arrest and anybody else who stands with Obama in this treason that we know has been committed.  When people inside these agencies recognize, and credibly recognize for themselves, that they are safe to act against Obama because they have the weight of public opinion behind them, then they will act.  In that article that I wrote about bin Laden, I said that it makes every bit of sense to me that one part of the community that needs that kind of protection is the United States Navy SEALS.  And they’re already upset with this clown named Obama.

MRS. RONDEAU: When I called the FBI last week, I mentioned that The Post & Email reports on all kinds of government corruption, including at the federal level.  I said, “For instance, Obama is using a phony social security number from Connecticut.  He’s a criminal, and we’re exposing that, too.”

LCDR FITZPATRICK: I sent you the YouTube video from this debt collector, and from minute mark 25 to the end is when the meat of the conversation comes out.  At the end, he said, “This man has committed various forms of fraud and identity theft with his criminal assistants.”  That particular property where Obama lived had six different ID numbers…he said, “This man has been nothing but a chameleon, changing his appearance, his background, over and over again.”  And this is a guy who had voted for Obama.  He seemed to say that his work mirrored that of Susan Daniels.  He didn’t need to call her up and say, “Hey, how’s it going?”  He said, “I found the same thing that she did.”

Using the scientific method, when one scientist conducts an experiment and records it step by step and comes up with a result which is life-changing, like the discovery of Super-Glue, for instance, that result is peer-reviewed by other scientists.  Other scientists are going to come in.  Let’s say that it is the discovery of E = MC2, or the discovery of the vaccine for polio.  If a scientist who is going to review the work of his peers, he or she is going to take the notes turned over by the first scientist who made the discovery and give them to not only one peer, but several, and say, “OK, go check it out for yourself.”  If the experiment can be repeated in exactly the same fashion step by step and produce the same result, then you have a discovery which is attributed to the first scientist who made the discovery.  So what Susan Daniels did was to repeat the same process that he used in the same business using the same kind of investigative techniques that he used, and she came up with the same results, independent of this man.  Applying the concept of the scientific method, both of these examiners came up with a result using the same process, and that is how things are legitimately confirmed.

I was told months ago that Obama was going to be arrested by the FBI within 90 days, but I haven’t heard anything else about it since.
