(Feb. 17, 2024) — On Saturday morning, upstate New York resident Robert C. Laity contacted his state assemblyman, William Conrad, regarding the mispresentation of the New York State Board of Elections (NYSBOE) of the “citizenship” constitutional presidential eligibility criterion as “born a citizen” rather than the actual Article II, Section 1, clause 5 term, “natural born Citizen.”

In New York, members of the state legislature’s House of Representatives are referred to as “assemblymen” or “assemblywomen.”

A copy of the letter was also sent to State Senator Sean Ryan.

Laity discovered the misstatement in 2009 after challenging the constitutional eligibility of both 2008 major-party presidential candidates John McCain and Barack Hussein Obama.

As The Post & Email has reported over the years, on multiple occasions Laity has pointed out the NYSBOE’s error, receiving no response until February 10 of this year. The lengthy document from Chief Enforcement Counsel Michael L. Johnson not only deviated from the issue at hand, but also rationaled the NYSBOE’s inaccurate terminology by citing its disclaimer, posted for the benefit of those planning to run for office, advising they consult New York “Election Law for specific petition requirements.”

Laity had also sent his January 2 complaint to Gov. Kathy Hochul, Lt. Gov. Antonio Delgado, the New York State Division of Election Law Enforcement, Attorney General Letitia James, and U.S. Congresswoman Elise Stefanik (NY21), the current House Republican Conference Chair.

In Saturday’s letter to Conrad, Laity wrote:

I have had a very longstanding complaint against the New York State Board of Elections of over fifteen (15) years duration.

My complaint involves the willful misrepresentation by the NY Board of Elections of the U.S. Constitutional criteria required to hold the office of President of the United States. I use the word “willful” because the general counsel for the Board admitted that its representations are in error.

The NY Board of Elections misrepresents the criteria in Article II, USConst. That of requiring a President to be a “Natural Born Citizen”. The NYBOE having substituted the erroneous term “born a Citizen.”

Attaching his recent correspondence with the NYSBOE and the other parties, including Johnson’s response, Laity concluded the communication, “There is no lawful rationale for the NY Board of Elections to continue to lie to the citizens of NY.”

Updated Feb. 19, 2024, 7:21 a.m. to reflect that Laity copied his correspondence to State Senator Sean Ryan.

Robert,
Would you consider contacting the Shiva for President campaign because he is suffering under some kind of delusion he can be converted legally in to a “natural born” citizen? I used the listed phone contact but ended up only being able to speak with a volunteer coordinator. That man became agitated when I brought up this issue and insisted Dr Shiva had obtained a legal opinion that this was possible. The reason I attempted to interact with Dr Shiva is because I believed his campaign for the presidency could be converted into a campaign to promote the direct election of Presidential Electors, a right clarified in the Ratification Debates. This was widely recognized and in use until, around 1856 (suspicious timing considering the results of the 1860 election) when the major parties and state legislators began colluding to hand the choosing of Electors to the political parties. Dr Shiva could end up having a major influence on the election this year (and a significant lawsuit against a law firm). There would need to be a significant first amendment petition campaign to force the state legislatures into compliance but I believe there are plenty on the right and left who want this unconstitutional privileged behavior ended. Ratification debates are posted on ReclaimingtheRepublic.org as well as an article under Constitutional perspectives section titled Why Vkunties Matter Most where the history of the theft of suffrage on electing Presidential Electors has been documented towards the last half of that document (a work in progress). Feel free to contact me and Sharon may give you my contact info if you want further info I collected on Dr Shiva’s campaign.I think he is a terrific individual just misguided on the constitution.

Bless you Robert for your never ceasing efforts to pull the veil from the abandonment of our Constitution, and an honest rule of law that has been obvious with oath taking entities of our political system at least since 9/11 “never forget Building 7.” Likely much longer in the past than we the people have been able to unravel. The Kenyan Manchurian Obama being simply the most obvious coup upon our nation by an endless gaggle of compromised leaders, and at worse, willing traitors. As recent as this morning, March 12, 2024, I watched Senate pundits raise the issue of 9/11 Saudi hijackers before the FBI director, totally complicit in ignoring the treason by our entire government body of a false flag murdering thousands of their citizens, dragging us into foreign wars, suffering and death of misled patriots, deaths of millions of civilians, and trillions wasted in national treasure. Sadly, I do not expect the entire government, corporate, and media monsters to repent and turn themselves over for accountability before destroying the world around them.

This same letter was also simultaneously sent to Sean Ryan, NY State Senator, NY Senate District #60.
