SOLITARY CONFINEMENT, NO MAIL AND NO PHONE ACCESS HAVE BEEN REPORTED

by Sharon Rondeau

Walter Francis Fitzpatrick, III has been exposing judicial corruption in Monroe County, TN for more than two years. Law enforcement's response has been, "Live with it!"

(Oct. 3, 2011) — The Post & Email received a report last evening at approximately 5:35 p.m. EDT that LCDR Walter Fitzpatrick, who was arrested following a sentencing hearing on September 23, 2011, is being kept in solitary confinement and has been denied mail and the ability to make telephone calls.

Numbers for contacts in Tennessee and at the federal level can be found in Neil Turner’s article dated September 30, 2011.

Are there veterans or patriotic citizen groups in eastern Tennessee willing to take action on the reported civil rights violations taking place against Fitzpatrick and others in the Monroe County jail?  Is there an Oathkeepers organization in that area willing to step forward and speak out?  Is anyone in Monroe County willing to challenge the judges, sheriff’s department, and complicit court personnel about their criminal behavior?

Is there an attorney who specializes in RICO, civil rights deprivation, or violation of the Fifth Amendment willing to take on the law-breakers in Monroe County?

Or is everyone simply too afraid, the way people were in the Soviet Union?

If so, then it appears that life there will not change.

A report gleaned from a Monroe County resident today stated that Fitzpatrick was originally held in Cell 3 but later moved to Cell 9, which is a “medical cell” normally designated for those with psychiatric disorders or other suspected problems.  There is no television as there is in the other cells, and the toilet cannot be flushed by the inmate.  Rather, it is flushed “from the outside” when a guard makes his rounds for the day.  There is no running water, and the walls are painted bright pink.  The lights are reportedly kept on all of the time and the confinement is more restrictive than in other cells.

A visitor stated that he had a 30-minute visit over the weekend with Fitzpatrick after waiting about 90 minutes to see him.  The visitor reported that that is not unusual for the Monroe County jail because they are “very disorganized.”  The visitor said that he saw no bruises on Fitzpatrick and that “he is letting his beard grow.”

LCDR Fitzpatrick had brought a complaint of treason against Barack Hussein Obama II in 2009 after U.S. Army troops were deployed illegally, at the admission of the Army Inspector General, into Samson, AL on March 10, 2009, in violation of the Posse Comitatus Act.  Fitzpatrick has since filed two more treason complaints with the FBI and U.S. Attorney for the Eastern District of Tennessee, William C. Killian, an Obama appointee.

Having been told by U.S. District Court Judge Royce Lamberth that the complaint was not judiciable in his court, Fitzpatrick took the complaint to his local grand jury in Monroe County, TN.  From there, he was obstructed on several occasions from presenting his evidence.  Through a series of encounters, requests and research over a period of about two years, Fitzpatrick discovered that the Monroe County grand jury was illicitly formed and operating as a device of the government.

It is unknown how many indictments have been sworn out by the acting foreman, Gary Pettway, for a period of about 27 years, and Fitzpatrick was sent aletterby the court clerk confirming that Pettway himself had never been sworn in as foreman.

As far as is known, Fitzpatrick must serve 70% of his six-month sentence for allegedly resisting arrest on October 27, 2010.  Fitzpatrick asserted at his sentencing hearing on September 23 that the court had no jurisdiction over him.

Fitzpatrick is a 20-year veteran of the U.S. Navy and is a graduate of the U.S. Naval Academy.   He holds a Master’s degree in Technology Management.

One person has taken action on Fitzpatrick’s current situation by contacting members of the major media:

I humbly request members of the media and publications to please investigate…

The following letter has been sent to Senators Alexander & Corker, Rep. Duncan, and Gov.. Bill Haslam as well as Lt. Gov. Ramsey.  (My address was added in the closing)

Dear Sirs,

Lt. Commander Walter Francis Fitzpatrick, III is being held UNCONSTITUTIONALLY in Monroe County Tennessee.  He was convicted and sentenced to 6 months in what I believe to be blatant retaliation for his continued efforts to expose corruption there..  Lt. Commander has been very respectful in his investigation as well as in his attempts to report his findings.  He has continued to be respectful even after repeated assaults on his person, character, constitutional, and civil rights.

Politicians and law enforcement agents alike have refused to even review Lt. Commander Fitzpatrick’s evidence much less investigate the crimes he is attempting to report.  It is my contention they refuse to investigate, not for lack of evidence, but rather for good old boy back scratching politics.  This is just wrong and absolutely NOT in the best interest of constituents or the public at large.  Not only have they refused to honor their oaths to protect and defend the constitution by taking appropriate action to investigate, but they are complicit.  These politicians and law enforcement agents are required to serve and protect the public and the United States of America.

Here is an article about what is going on in Monroe County as well as two neighboring counties.

If Monroe County has nothing to hide, why won’t they just simply release the PUBLIC records Lt. Commander Fitzpatrick has requested?

Additionally, thepostemail is a staunch supporter of Lt. Commander Fitzpatrick, they have been doing an ongoing expose of the situation and as such are very knowledgeable of the facts.  Recently their site was under a VERY aggressive cyber attack.  The question should be, Why? The answer is obvious.

Here are some of the articles by Sharon Rondeau’s thepostemail regarding Lt. Commander Walt Fitzpatrick:

In your research of Walt Fitzpatrick you will undoubtedly find some disparaging information attacking his character and questioning his mental well-being.  Rest assured these are false allegations in an effort to silence him and discredit him.  Clearly this is needed by opposition wishing to maintain the corruption cover-up.

I am earning my PhD in Psychology and am a senior level executive M.B.A. specializing in Human Asset Management with a “whole person” approach to placement.  I have many years of extensive experience working with veterans, homeless persons, recovering addicts, and felons re-entering civilian society through primary employment and second chance employment alike.  Lt. Commander Walt Fitzpatrick is of completely sound mind.  Further, I challenge anyone who does not believe that Lt. Commander Walt Fitzpatrick’s many years of dedicated and honorable service to this country, in and of itself, has earned him the benefit of the doubt.

Walt Fitzpatrick, III is a law abiding citizen with the utmost respect for our country, countrymen, and lawful authority..  He is a high ranking US Naval officer who served honorably to retirement.  He is a good man of faith and integrity.  Lt. Commander has honest & honorable intentions and is an oathkeeper of the truest stripe.  He is very articulate, remarkably intelligent, and has done extensive thoughtful research and investigation.

I am confident an honest review of Lt. Commander Walt Fitzpatrick’s evidence will not only prompt an expedient impartial investigation but will also secure his immediate release and public clearing of his erroneously & maliciously slandered name.  Lt. Commander Walt Fitzpatrick, III has earned a few moments of your time to report his findings. He has spent decades protecting life, liberty, and the pursuit of happiness.  Don’t you agree he deserves these same unobstructed rights in return?  I await your reply in earnest.

Respectfully,

Cheryl Denise Simmons, M.B.A. (Denise Simmons, just Denise, @walk2free)

I am outraged. Like any good Constitutionalist, I am well aware that the courts are not meant to be any part of government. Where do these people come from? — Disgusted in California. p.s. I am writing to Monroe Cty officials. We’ll see what good it might do, other than get me on some regime watch-list. Won’t be the first time.

It is now official, Walter Fitzpatrick is a Prisoner of War…illegal unconstitutional undeclared wars on terror which are hidden wars on American freedom and sovereignty.

Excellent article, P&E. It breaks my heart knowing Walter is in such danger. I am hoping and praying those who live near Tenn. can visit Walter and allow us to know his condition. Our letters are not reaching him. Also, anyone in the Tenn area or beyond can gather a group to pay Walter a visit.
Thank you for keeping us informed.

I am stunned at the treatment of this gentleman. The very people he was serving to protect from foreign and domestic enemies have treated him in the most unthinkable way. As an Australian, I cannot comprehend how such corruption and blatant abuse of law can exist in a country the world envies.
Is there no one in the armed forces and the general public who can band together and right what is so wrong? How sad to see a man who not only risked his life for 40 or so years so you people can continue to enjoy your freedoms, only to be discarded and locked up for exposing corrupt officials.
What an outrage, you people should be ashamed for letting this happen to such an honorable man. Enjoy whats left of your freedom…

“Mr Fitzpatrick, I am sorry these parasites have done this to you. Sir, you are what I call a true hero, hang in there mate.”
