WHY AREN’T THE LAWS ENFORCED?

(Dec. 8, 2014) — Last week, Judicial Watch announced that it would host a special presentation on the effects of illegal immigration and specifically, Obama’s impending “executive amnesty” plan announced on November 20.

Judicial Watch is a “conservative,” non-partisan government watchdog organization which uncovers corruption and crime in state governments and within the federal government.

The live presentation began at 2:00 p.m. EST with JW president Tom Fitton giving the introduction, referring to Congress’s unwillingness to enforce existing immigration law and what he said is Obama’s many violations of the U.S. Constitution.

Fitton cited statistics from various sectors of the population which appear to indicate that Obama’s “amnesty” plan is not supported by a majority of people legally in the country now.

Fitton spoke of the “memorandum” issued by then-DHS Secretary Janet Napolitano to enact the “DACA” program without statutory authority from Congress.  Fitton related that Congress has funded DACA for the past two years, which has led to Obama’s new “lawless amnesty” which will allow 5,000,000 people or more to remain in the country and compete for jobs with American citizens.

Obama’s “amnesty” was put in the form of a memorandum by current DHS Secretary Jeh Johnson.  “Amnesty is being implemented across the entire Obama administration,” Fitton said, because of Obama’s “abuse of power.”  Fitton asked if there are “honest Democrats” who oppose Obama’s plan, which Fitton believes will “cancel out” votes from U.S. citizens in federal elections.

JW had reported on a study which contended that enough votes from illegal aliens could have changed the outcome of the U.S. Senate and the presidency in 2012.

Fitton introduced Sessions as the ranking member of the Senate Judiciary Committee.  Sessions served in the U.S. Army Reserve and holds a J.D. from the University of Alabama.

Breitbart has reported that House Republicans plan on introducing an immigration bill early next year which will “legalize” all illegals except for the most hardened criminals, which appears to mirror Obama’s intent in the Johnson memorandum issued to three executive branch agencies dealing with illegal aliens.

Sessions said that “truth” should be pursued and used the analogy of a jury judging a defendant.  “We fight for our future, we fight for our country, we fight for the very rule of law which has made our country so prosperous…” he said.

Sessions contended that Obama is becoming that which the Founders warned about and tried to avoid by setting up checks and balances within the three branches of government.  He described the executive branch as a “fourth branch” which has assisted “the rise of an uber presidency,” quoting law professor Jonathan Turley.

Reading from an announcement from the USCIS for 1,000 new contract employees “as a result of the executive action” taken by Obama on illegal aliens, Sessions clarified that Obama’s actions have “gone beyond just talk.”  He said that businesses are not supposed to be hiring people in the country illegally but that “the president” says that they can work.  “We said ‘no’ to this,” he said of Congress.

Sessions quoted former Speaker of the House Newt Gingrich as having said that Obama’s creation of a new department without congressional approval means “he must be stopped.”  Gingrich suggested that Congress should approve only short-term spending bills without amnesty.  Gingrich said that Obama’s plan is a threat akin to “King George III.”  “I think we have a pretty serious situation here,” Sessions said.

“There was not even an executive order issued,” Sessions said, referring to JW’s discovery that the actions were dictated in the DHS memo signed by Johnson without legal or constitutional authority.  “It’s plainly unconstitutional,” Sessions said, stating that Obama is creating an “alternative immigration system.”

Sessions said that “the depth of what’s happening” is difficult for many to grasp, citing the salaries offered by the new job postings which have not been funded by Congress.

He said that illegals given work authorizations will obtain Social Security numbers, file income tax returns, and if eligible, receive the Earned Income Tax Credit and other benefits extended to U.S. citizens.
