PRISONER HELD INCOMMUNICADO IN VIOLATION OF THE TENNESSEE AND U.S. CONSTITUTIONS

October 17, 2011

The Monroe County Sheriff's Department is holding Walter Francis Fitzpatrick, III in solitary confinement for an alleged contempt of court charge

Governor Haslam, Representative Duncan, Senators Alexander and Corker,

Attorney General Cooper:

Attached: cover pages for file #11366, 10th Judicial District

Gentlemen:

We are (or were) a Nation of Laws. Those laws that are not inalienable come from our Constitution.  The Constitution of the United States has no caveats; no sometimes we do and sometimes we don’t.  The Constitution says what it means and means what it says.  And it served us well, into the 20th century.

At the very heart of our American jurisprudence system is the writ of habeas corpus.  The Constitution is so emphatic about the writ of habeas corpus that it states: “The Privilege of the Writ of Habeas Corpus shall not be suspended, . . .“

I filed a writ of habeas corpus on October 6, 2011 and follow on non response for release to court of Walter Fitzpatrick III.  As of today there has been no activity on this writ.  It is customary and by request and precedent to act on habeas writs within 72 hours.  Nearly two weeks have passed.  LCDR Fitzpatrick’s Privilege of the Writ of Habeas Corpus has been suspended by the 10th Judicial District and the state of Tennessee, for all intents and purposes.

Exigent circumstances exist.  Your attention to this matter is urgently requested.

                                                                                                                               For the Republic,

                                                                                                                                M. J. Blanchard

Editor’s Note:  The writer added the following to this editor:

The take away that I got from Walt last week is that folks on the “outside” should keep hammering the pols and legal system for his release.  Walt is being held incommunicado, essentially.   He does not have telephone or writing privileges so there is nothing he can do.  Walt is fine, but would be encouraged if folks would support the effort.  Bringing attention to him addresses the greater issue and that is what Walt is all about.

This is not a worry item just another example of the abject corruption in the jurisprudence system.
Darren’s attorney reported that Walt was transferred to the Blount County jail in preparation for his testimony. The attorney thought here would be chance of getting paperwork to Walt while he was in that facility so that was attempted but Walt wasn’t there. Inquiries back at the Monroe County jail revealed that he wasn’t her either. Walt has been “disappeared”, again.
This is what they do to political prisoners in third world countries. Are we on the way to becoming a third world country, or have we arrived?

This corruption and lawlessness is so typical of the criminals that now infest our state and federal governments. The last thing that these criminals will peacefully allow is the enforcement of state and federal laws. The Monroe County Tennessee tyrants are of the highest order, and will remain in power as long as the people of Tennessee stand down and allow the crimes to happen.

Tennessee, in spite of its great history, is the last place I would choose to visit, well, aside from Chicago. I would only hope that other law abiding Americans restrict their travels and vacations to states that are lawful. If these kinds of crimes are committed against an honorable veteran in Monroe County, they will be committed against anyone who legally challenges their unlawful actions.

Tennesseans need to stop tolerating this county and state government madness now. Their future depends on their actions today.

Sharon, I sent all of this to Amnesty International some time ago and got a response. They said they would be looking into it, which I forwarded to you earlier. Have you ever been contacted by them? It looks like they are only interested in other countries. I’m totally surprised that they haven’t jumped at the chance to embarrass Americans.

The response from Haslam was: “As Governor, I have no jurisdiction or control over the Judicial Branch . . .”
The letter was quite clear that the judicial branch had failed to respond, to writs, to letters. to phone calls, etc.
What part of Governors Special Task Force do we suppose Haslam does not understand?
