“A DISASTROUS TRANSGRESSION”
October 4, 2011
Mark:

I heard you the other day say that Marco Rubio was a natural born Citizen, period, end of story. You were very exercised over the issue.
Marco Rubio is NOT a ‘natural born Citizen‘. The ONLY place in the Constitution, or in any of the amendments where that phrase is used is in Article II, Section 1. You know that. It was meant to be a unique requirement of someone who would be President, or Vice President.
The Supreme Court has affirmed the definition of NBC in Minor v. Happersett, 88 U.S. 162 (1875), and the Senate affirmed the two-citizen-parent requirement in April of 2008 with it’s non-binding Resolution 511 as it pertained to McCain. Finally the intent of the Founding Fathers as to NBC can be found in their writings, with which I know you are most familiar.
Rubio’s parents were not American Citizens when he was born.
You profess to love the Constitution. I believe you.
I know why you have to maintain your insistence that Rubio is a ‘natural born Citizen‘. To deny that puts you squarely in the middle of the Birther controversy. To be front and center on Rubio would put you front and center on Obama, who had at least one parent who was not an American Citizen.
I’m not sure, but I presume you’ve been told that under no circumstance, if you want to maintain your network of radio stations, are you to side with the Birthers, or Constitutionalists.
If so, your hands are tied if you choose to enjoy your comfortable life style over love for this country and what it stands for.
I will continue to listen to you, but I hope when this is finally out, and the truth is known far and wide, you will apologize to your listeners for this disastrous transgression.
I for one will NEVER vote for any ticket which includes Marco Rubio. There are millions more who are of the same mind set. I have not fought this battle for three years to give up my principles now.
Thank you,
Rob Lamb

Thanks very much for opening comments back up. I enjoy the posts and comments.
On this subject, While Rubio might make a good President, unless the constitution is changed, he is not eligible and I would not vote for him under any circumstances as long as he is not eligible.
Along with Levin, all of Fox News regular contributors are part of the attempt to make the illegal usurper appear to be eligible to those who don’t know, or don’t care to know, what natural born Citizen means. Fox talking heads fear the Obama regime, and I expect their bosses, who have apparently told them Obama’s eligibility, bogus SS number and fake BC are off-limits.
They can be critical of Obama, but only in a controlled way which will bring him no real harm.
Turn off Fox News.
I wrote to Sen.Rubio a couple of weeks ago, asking him to Please set the talking heads on fox news straight on his citizenship and to please stand up for the constitution . I like Sen. Rubio but there is no way i’d ever vote for him for VP.or POTUS.
It won’t matter to Cumulus Media, who bought Citadel Radio last year. It’s the same corporate drivel only now it’s done out of Atlanta, GA.
Marco Rubio and Bobby Jindyl both….are not constitutionally eligible to be president or vice president. What is wrong with these so-called “conservative scholars?” Are they all a bunch of RINO’S dishing out the political slop just to get us to buy into their brand of americanism?
This issue has got to be brought to the forefront right now, before we have the 2012 elections and we the people have to know whether or not we are going to have a representative Republic….or a political dictatorship based upon the whims and the misrepresentations of a handful of partisan elites.
Where is Judicial Watch or the ACLU or the American Center for Law and Justice? As you may know, the Federal Elections Commission recently ruled that a naturalized citizen from Africa ( a foreign born national) is eligible to seek the office of POTUS but that he is not eligible to receive any federal matching funds. Is this crazy or what? Since when did the FEC get the authority to interpret the Constitution?
As a nation, we are in dire peril. As a free people, we are still in charge. Let’s get the message out before all of our resources are compromised by this usurper in the White House and all of his partisan brotherhood in the Congress and in the Courts.
We have fought this issue for three years now. The GOP at the bottom and some at the top are determined to fight fire with fire, this is unconscionable. Two wrongs do NOT make a right. Rubio is not eligible to be President or Vice President, his parents were not born in the US, they were born in Cuba. If Rubio’s children decide one day to run for POTUS or VP, so be it, they are natural born citizens. Even the Presidential candidates are saying they would have Rubio as VP. When I called Rubio’s office to ask if he has plans to run, the female staffer’s statement was “Senator Rubio has no plans to run for POTUS or VP soon?” Is there a change coming in the Constitution that we do not know about? Mark, you need to explain yourself on this issue, you’re the Constitutional Attorney. It seems as though “the upper echelon are walking Rubio down the carpet to take his VP oath.” I will in no way breach the Constitution of the United States, Rubio can not be POTUS or VP, sorry.
It would seem reasonable to demand that any person in the line of succession to the presidency be required to be a natural born citizen.
I agree llex, however it matters NOT where Rubio’s parents were born. It only matters
that they were NOT CITIZENS at the time of Marco’s birth. Had they been naturalized
and taken the oath of citizenship before his birth, he would have been eligible.
The words we use are inadequate. Too much confusion amongst our citizens about
natural born, naturalized, native born (of citizen parents or non-citizen parents).
All of the many uninformed voters merely vote for the most pop(ular) candidate because
they “like” him/her.
I heard that even a Federal Judge thought that the parents ALSO had to be natural born, and
was confused by the terms used.
I like and respect Mark Levin, but on this matter he is dead wrong. I have no idea where he confused everything about this subject, and I would like to see him try to justify his position from a legal perspective.
Regarding Sean Hannity, he’s a commentator on Fox News, and is no legal genius at all. He’s a good supporter of the republican party, but that’s about all. I’ve caught him on several misstatements about constitutional law.
Judge Napolitano gets it right, and I believe his comments are more legally accurate than those of Levin.

Dear Mark,
I am sending this as a response to the following:
Click here: Open Letter to Mark Levin Re: Natural Born Citizen| The Post & Email
I have screamed at you for over two and one-half years because, with all of your asserted love of and respect for the U S Constitution, you have deliberately refused to even discuss the FACT that obama, by his own admission, was born — and who cares where — of a Father who was never a US Citizen.
By the requirements of the U S. Constitution, by legal precedent and with the confirmation of our exalted U S Senate, in the vetting of John McCain to be eligible to run for the presidency, a ‘natural born citizen’ is one born of two U S citizen parents.
obama was never eligible to run for the presidency and you kept silent. Now you are standing up and trying to pretend that Marco Rubio is a ‘natural born citizen’ in spite of the open knowledge that NEITHER OF MARCO RUBIO’S PARENTS WAS A U S CITIZEN WHEN HE WAS BORN IN MIAMI, FLORIDA.
Your credibility on every issue from this day forward is obliterated because you refuse to read the Constitution and stand up for what is clearly states.
The gentleman who wrote the letter linked above is correct. Even though you are not included, there are millions of citizens who still care about the Constitution and what it says. We have had to endure three years of an ineligible usurper sitting in the White House and watch him destroy the country, and if you think we are going to sit silently by and watch another usurper try to get elected you are sadly mistaken!!
We will flood the courts and the media with challenges to any Rubio candidacy — to try to prevent the further abrogation of our Constitution — which at the very least will irrevocably tarnish the campaign ticket on which Rubio might run — and like the author of the letter above, millions of us, including myself, will refuse to vote for the ticket on which Rubio might run — no matter who might lead that ticket — because he is on the ticket.
I cannot describe my heartbreak that you have hidden your head in the sand regarding the clear mandates of the U S Constitution and are apparently willing to continue doing so. Shame on you!!!
During his TV show last night Sean Hannity said “Someday Rubio will be President” with a facial expression and in a tone which left no doubt he doesn’t care that Rubio is not eligible.
Thank you Mr. Lamb! He is confusing a lot of people on this issue because I’ve been arguing with them over the matter on a forum. They think Marco Rubio is qualified because Mark Levin says so! This is wrong and he should be ashamed of himself. I guess money and status is more important to him than standing up for what’s right. I wouldn’t listen to him if he were the ONLY person on the radio. The only way to clearly show your displeasure is to cut him off and hit him in the pocket, where it matters the most to him. No way, no how will I vote for Rubio on anybody’s ticket!
Excellent letter to the talk show host! He talks big about the Constitution, yet with this whole issue of Obama’s ineligibility due to his unconstitutional status to serve as legitimate president, Mark Levin illustrates a personal conspiracy of denial, arrogance and silence.
I think the last sentence of the letter expresses what I’ve been saying online, for some time now:
“I for one will NEVER vote for any ticket which includes Marco Rubio. There are millions more who are of the same mind set. I have not fought this battle for three years to give up my principles now.”
I, for one have posted online a number of blogs dealing with the eligibility issue, etc. One of my latest explains why the Republicans will lose votes for their GOP nominee, should that candidate avoid the important issue of Obama’s presidential illegitimacy:

Marco Rubio, born in the US to alien (Cuban citizen) parents, is not a natural born citizen because a natural born citizen cannot be a naturalized citizen. Rubio is a naturalized citizen at birth — naturalized per the 14th Amendment to the US Constitution as codified into US statutes (Title 8 Section 1401).
A natural born citizen is a person who is not a naturalized citizen (at birth or as an adult) and whose citizenship is established at birth by the laws of nature and not by any law of man (such as the 14th amendment, or any naturalization act). A natural born citizen is born in the country to citizen parents and does not need any human law to say that he is a citizen at birth. His US citizenship and exclusive allegiance to the US is self-evident to all and no foreign country can lay any claim to his citizenship and allegiance at birth.
I like Rubio, I voted for rubio, because of his conservative ideas, but he is not eligible to be President!!
Reminds me of a story that took place in Germany in the 1930s.
First they came for the communists, and I didn’t speak out because I wasn’t a communist.
Then they came for the trade unionists, and I didn’t speak out because I wasn’t a trade unionist.
Then they came for the Jews, and I didn’t speak out because I wasn’t a Jew.
Then they came for me and there was no one left to speak out for me.
