IS THIS PROPER SERVICE?

Why were Monroe County Sheriff's Deputies at Walter Fitzpatrick's residence recently?

(Feb. 1, 2011) The Post & Email has learned that Monroe County Sheriff’s Deputies have paid at least two recent visits to the home of Walter Francis Fitzpatrick, III. Neighbors in the area reported seeing sheriff’s deputies at his home in Sweetwater on Friday, at about noontime, and on Monday, January 31, slightly earlier in the day.

The only evidence of their visit was a 4 x 5-inch paper with a handwritten note on it asking Fitzpatrick to contact the sheriff’s department regarding a subpoena for a hearing for Mr. William Click, which is to be held tomorrow at the Monroe County courthouse.  The note was signed by Deputy Jason Russell and asked Fitzpatrick to call the department at 519-1906 so that they could serve him with a subpoena to appear.

The note was smudged, torn and smeared from being out in the rain and snow.

Fitzpatrick had reported from the Monroe County jail that Mr. William Click had assaulted him while he sat on his bunk toward the end of his 60-day sentence.

At 9:27 a.m., Officer Trent Prock of the Monroe County contacted The Post & Email, returning our call to the sheriff’s department the evening before at about 5:10 p.m.  Prock acknowledged that the deputies had been to Fitzpatrick’s home twice with the purpose of serving him with notice of a subpoena.  He said that Fitzpatrick “wouldn’t answer the door” and that Fitzpatrick could “stop by and pick it up” at the sheriff’s department.  He stated that the deputies had left a business card.  When we asked the date of the hearing, he said, “I don’t know.”  Prock acknowledged that the subpoena was for a hearing for the man who assaulted Fitzpatrick in jail.

  1. This is outrageous. How difficult would it be to have a little computer with a printer in the squad car. Or if TN is really so backwards they could have a typewriter in the car to leave notes. Nobody leaves a handwritten note any more. Very sad.

If Walt follows thru with the charges as requested by the officers and this Mr.Click is found to have not done anything, then they will charge Walt with filing a false complaint and contempt of court, along with a few other charges. They are trying to get closer to the three strikes charge on Walt. Walt could just file an Affidavit and statement of facts to the best of his knowledge. Then the officers would have his statement, only to the best of his knowledge, went you have been assaulted it is sometime hard to remember all of the facts. So the disclaimer will cover your butt. The court can file the charges without Walt being present if they really want too? The duty to be oppressed is alive and well. I would just post my property in the windows and file trespass of an officer with a deadly weapon, with the intent to do bodily harm, If they come back there is still the thing called mail. Those charges might get someones attention. When they (officers) set foot on your front porch they have committed a second degree felony. Armed trespass, the badge does not give them that right. If your rent then all of the rented area of property is protected and the front porch is part of your rental home. They are at your door they will be under your house, and behind your house they are everywhere, this is what they are doing Walt scaring your into Oppression. If you read the city contract they do not allow a police officer nor code enforcement to pass a posted sign, to do it right the law requires all four sides to be posted of your home or property. Take care, old friend. The police us your doorbell to get around this part of trespass law. Cover it up and put a sign that says not one welcome. If you have a doorbell or door knocker, they say you have already invited them to knock on your door. That is the loophole for the badge and gunners.

This has to be one the most outrageous reports of egregious activity I have ever heard .The Sheriffs Dept. can’t deliver a notification without it looking like it had been drug through hell and Officer Trent Prock, an officer of the law ? who hasn’t any idea about the particulars, amazing, simply amazing! Sounds to me like another setup, and I have every confidence that Mr. Fitzpatrick is well aware. I of course not being a officer of any court, thought that subpoenas had to be handed directly to the individual being summoned, but then again, Monroe County seems to do business not within accepted laws, but rather by whim and fancy. You can bet that after hearing about the corruption going on in Tennessee, I will stay well clear of that State. I would
    feel safer in Mexico.
