LETTER CLAIMS THAT ALL GRAND JURY INDICTMENTS FOR THE LAST TWO DECADES ARE NULL AND VOID

Are innocent people in jail today because of an illicit grand jury?

(Oct. 26, 2010) — The following letter was received by The Post & Email from Walter Francis Fitzpatrick, III via email on August 28, 2010.

Walt,

How’s it going?

I haven’t heard from you in awhile.

I wanted to write and let you know what’s going on here.

So far, I’ve proved in the criminal court that every indictment produced by the Monroe County grand jury has been illegal for the past 20 yrs.

It has been verified by the Attorney General’s office in Nashville. By Mr. Clay Lutz*.

I addressed three different issues in my petition and he verified my petition.

I don’t get the news paper, but I got this week’s by chance and say that you made the front page. I hope things are going well for you.

I am now waiting on the court to do what they should by law. They have had proof for some time now that I am in fact being held illegally.

I’ve contacted the A.C.L.U., but haven’t heard anything from them.

I saw in the paper that they charged you for violating the civil rights of the grand jury member. I’ve proven they’ve violated several of my civil rights, and they are still in no hurry to correct that.

Another reason I’m writing is that the last time I wrote the paper, I got no response. I’m going to write them again, but I won’t know if they’ve printed anything on this matter.

I don’t have an attorney, so I’ve been doing this pro se.

Clay Lutz verified my petition, but he also wrote a motion to dismiss. Saying I didn’t file in the right court. I wrote a rebuttal so now I’m waiting on the judge.

I also quoted T.C.A. law that states that it is the judge’s duty to correct an illegality although no application be made thereof. T.C.A. 29-21-104.

And as I’ve said, proof has been presented to the court. Maybe this will help you as a back-up plan.

I really need some media coverage.

I’ve produced documented proof that I have a learning disability, and ask for appointment of conusel, but I’ve not heard, or they haven’t responded in any way.

The attorney general has not rebutted my claim, he only asked for dismissals based upon procedure.
