Open Letter to ALL NY Legislators AND Governor Cuomo.

At 12:30 PM, Wednesday, April 22, 2015 in Room 630 LOB the Assembly Codes Committee will consider a vote on 8 Safe Act Repeal Bills.

REQUEST by the NY Citizens Coalition : Please demand the Codes Committee to bring The FULL Repeal of the Safe Act Bills of A2651 Katz [same as S1476 MARCHIONE ] and/or A3350 Tenney [no same as ] to the floor for a vote.  Supporting testimony follows:

The citizens of New York have supplied every one of you with reams of facts, figures and evidence on why the Safe Act MUST be FULLY Repealed. We now inform you of how Political Poison WILL be turned into a Political Asset for YOU.

What is Political Poison?

In 2014 Political Poison was The Safe Act. It was the single issue that caused big changes in the New York legislature and also reduced Governor Cuomo winning election votes by 50%. Moving into the future the Safe Act WILL remain the biggest Political Poison – especially for the Democrat Party, UNLESS it is repealed. The damage the Safe Act causes will NOT go away; it WILL grow even larger until it is eradicated.

While many may have considered the Safe Act to be a worthwhile and a productive piece of legislation, it turns out that it is the total opposite. It is counterproductive, to say the least. The Safe Act has produced only negative results. There is not one shred of positivity connected to The Safe Act. The Safe Act has lowered the credibility of ALL of New York State. It has also brought only contempt and cynicism to New York’s government.

Eventually most of the Safe Act WILL be found unconstitutional, but that is the least relevant. The statute is poison; 22 state attorneys general have joined onto the Safe Act opposition amicus brief.  Fifty-two (52) of the 62 New York counties are resolved to oppose the enforcement of the Safe Act along with countless numbers of highly respected organizations. 1,500,000 personal petitions for FULL repeal of the Safe Act were signed and delivered to every legislator.  It is broadly seen as wrongful; from its beginning, its enactment, its enforcement and its persecution of law-abiding citizens. The Safe is poison – period.

Turning Political Poison into a Political Asset :

People admire admission when an error was made. Admit the unintentional corruption it caused. This WILL have a total positive effect toward lawmakers across the spectrum of ALL people. FULLY Repeal the Safe Act!

At the same time introduce a broader form of Mark’s Law. Broader in the fact that Mark’s Law will increase penalties for criminal violence not only committed upon law enforcement and first responders but now includes criminal violence committed on ALL people.

NOTE: Curtailing violent crime was the intention of the Safe Act and this is what will fulfill the people’s hopes and desires. This will unite government with the people. By admitting a mistake, correcting the mistake and implementing a new statute that really does reduce criminal violence and really does make citizens SAFER. It turns political poison into a political asset.

Re: Mental Illness: The Safe Act creates more problems for society, the mentally ill and the mental health caregivers – that is widely acknowledged. We all want to help the mentally ill and also want less violence, but the Safe Act does NOT address the issues properly. It just makes a mess, creates confusion and unduly restricts too broad of segments of our society.   It also is preventing those with mental problems from seeking help – a serious miscalculation on the Safe Act. Mental illness problems must be addressed as a standalone issue – NOT by way of the Safe Act or other firearm legislation. FULL Repeal of the Safe Act would actually be helpful for preventing violence committed by the mentally ill.

We once again ask that YOU Please demand the Codes Committee to bring The FULL Repeal of the Safe Act Bills of A2651 Katz [same as S1476 MARCHIONE ] and/or A3350 Tenney [no same as ] to the floor for a vote.
