Thank you for taking the time to contact me regarding your strong opposition to the New York SAFE Act and for sharing your ideas regarding its repeal.  It was a pleasure to hear from you, and I appreciate your views, ideas, and suggestions on this vitally important issue.

Protecting our Second Amendment rights is a profound responsibility that I have always taken very seriously.  As your New York State Senator, I have been an outspoken leader in the effort to safeguard all of our constitutional rights, and in particular, the right to bear arms!

My steadfast commitment to protecting the Second Amendment rights of law-abiding, legal gun owners, was the reason I strongly opposed and voted against Governor Cuomo’s so-called SAFE Act, and that is why I am continuing my efforts to repeal this misdirected legislation.

You and I know that responsible, law-abiding gun owners are not the cause of the problem, and that they should not be penalized.  The focus to prevent violence should be on commonsense measures to increase the penalties for people who use guns to commit crimes and on legislation to strengthen New York’s mental health system and criminal justice laws.

That is why I am pleased to advise you that I have personally introduced legislation for the 2015 legislative session, which would REPEAL the so-called SAFE Act. This misguided and ineffective law has infringed on the rights of responsible gun owners for too long.  My legislation, Senate Bill 511, fully repeals the SAFE Act, but keeps intact the provision in law which mandates life without parole for anyone found guilty of murdering an emergency responder. In addition, I have partnered with several of my colleagues in the Senate who are also working to repeal the SAFE Act.  I am currently co-sponsoring two very important measures, Senate Bills 2612 and 2613.  These measures would remove the seven round magazine limit and terminate the requirement of registration of ammunition retailers and background checks for the purchase of ammunition.  Please visit:   http://open.nysenate.gov/legislation/bill/S2612A-2015 and   http://open.nysenate.gov/legislation/bill/S2613-2015 to review these measures.

Please know that I am doing everything I can to eliminate the funding needed to implement many of the provisions in the Governor’s SAFE Act.  I will continue to work throughout the budget process to defund the SAFE Act in any way possible.

Downstate members of the State Assembly and the Governor, who both championed the SAFE Act, continue to stand behind this measure even as the SAFE Act remains ineffective, unpopular, unfair and unconstitutional.  Although the obstacles against repealing the SAFE Act are numerous, we need to make every effort to repeal this law and reinstate our Second Amendment rights, and I am fully committed to this objective.

Currently, there are numerous legislative measures supported primarily by New York City democrats which seek to infringe further on the constitutional rights of New York State gun owners such as: a proposal that would require gun owners to purchase a minimum of $250,000 in liability insurance; a proposal which would threaten prison time for anyone who does not store their firearms under lock and key; a measure to prohibit the number of firearms an individual can purchase in a certain time period; and legislation prohibiting ownership of .50 caliber weapons. As Chairman of the New York State Senate Codes Committee, I will vigorously oppose these measures and any new legislation that attempts to further erode the rights of law-abiding gun owners.
