REGARDING THE 16TH AMENDMENT

There seems to be some confusion about the why, who, where, when and how the research proving that the 16th amendment (income tax) to the Constitution for the united States of America was accomplished. I will try to clarify.
Late one night, June of 1980, I was having a lengthy phone conversation with another patriotic Montanan. Sam XXXX asked me whether I believe the 16th amendment had been lawfully declared ratified? I responded by saying; “that our tax-consuming public servants had a poor track record for truth”. Sam said; “we are going to find out if the 16th amendment was properly ratified as a Constitutional Amendment.”
Sam enlisted several other farmers, ranchers and business people who called themselves the MONTANA HISTORIANS. I won’t name them for fear of leaving someone out. They used phone calls and letters to archivists and record keepers in the forty-eight States that were in existence in 1913. They requested copies of State Senate and House journals that recorded the debates and votes on the proposed 16th amendment.
In the fall of 1980 one of the researchers discovered Senate Document 240 in the Montana State Law library. When I wrote the book ‘Born Again Republic” in the fall of 1980, I wrote on pages 98 and 99 about the 16th amendment not being lawfully ratified. Senate Document 240 proves our Public Servants knew the 16th amendment was a fraud.
By January 1983, the Montana Historians had collected the House and Senate journals for the 48 states. Some records were more complete than others but the evidence of fraud was unimpeachable. I published two books in 1983 and wrote of the fraud in both. “Do Unto The IRS As They Would Do Unto You” and “The IRS And The Black Robed Cover-up” were the two books.
In March of 1983, I was called as a witness in an Income Tax criminal trial in Fort Worth, Texas. I had copies of the documents collected by the Montana Historians and I testified that the 16th amendment and the Individual Income Tax are a fraud. The Federal Judge would not let the jury hear my testimony.
In April 1983 I was in Chicago and Bill Benson and an attorney, Andy Spiegle purchased an extra set of the documents which I had with me. In June 1983 I testified in the Allen Lee Buchta criminal prosecution in Hammond, Indiana Federal Court. Andy Spiegle defended the Buchta case with Bill Benson as his paralegal. Andy tried to enter the 16th amendment documentation but Federal District Judge Moody refused to accept the evidence because it was not certified. Judge Moody should have recessed the trial until the Justice department checked our evidence for accuracy. Allan Lee Buchta was found ’guilty’ and sent to jail. Judge Moody became a accessory to the worst criminal cover-up in our nation’s history.
As a result of Judge Moody and his failure, Bill Benson agreed to travel to the 48 State capitals and collect certified copies of all the documents concerning the ratification of the 16th and 17th amendments. The Montana Historians had also collected the evidence of the fraudulent ratification of the17th amendment. Bill Benson spent several months of 1984 traveling and completed the 48th State in Olympia, Washington Christmas eve of 1984.
The Montana Historians are not getting the credit they deserve. It was the fall of 1980 when Senate Document 240 was found and it was more than sufficient evidence proving the 16th amendment was a fraud. The Montana Historians did not stop there. They continued to collect the Senate and House Journals for the 48 States. They have established a place of honor in our history that is well deserved.
Federal Judges and the US Justice department have established a place of dishonor in our history. They will be known as criminals who have perpetrated the most serious COVER-UP in our history. Every victim of IRS oppression and prosecution need to know how unknown, patriotic ranchers, farmers and businessmen uncovered a pattern of criminal activity by unfaithful public servants.
