(Oct. 10, 2009) — Judge David O. Carter is currently considering the case of Captain Pamela Barnett et al. vs. Barack Hussein Obama et al., in the Federal District Court, Central District, Southern Division of California.  Lead plaintiffs in the case are Attorney Orly Taitz, esq., and acting Attorney General George S. Cardona.

From time to time The Post & Email will feature notable public officials in Spotlight reports, so that the public may better understand the person behind the news.

Education and Military Service

David O. Carter was born in Providence, Rhode Island, on March 28,1944.  He has a modest biography at Wikipedia due to his ruling in Colin ex rel. Colin v. Orange Unified School District, where he forced a public school to accept allow a political-activist organization, the Gay-Straight Alliance, to hold meetings on public property.

David Carter graduated with a B.A. in 1967 from the University of California at Los Angeles.

After College he enlisted — apparently for 4 years — with the U.S Marines Corp and served a tour of duty in Viet Nam. He was decorated with a Bronze Star and Purple Heart;  leaving the service with the rank of Lieutenant.  He fought at the famous battle of Khe Sahn, where as member of the 1st Platoon of the U.S. Marines, he was wounded, according to the book Valley of Decision: The Battle of Khe Sahn, by John Prados & Ray W. Stubbe, 2004., p. 445.

Upon discharge, he returned to his alma mater and earned a Juris Doctor at their Law School in 1972.

Career Fighting Crime

No sooner had he graduated that he was appointed District attorney, Orange County, California, a position he served in until 1981. He was in charge of the homicide division.

He was then nominated to the position of Judge, in the Western Division, Orange County Municipal Court, California, 1981-1982; and served in Eastern Division of the same in 1982. He was promoted to Superior Court in the same country in that same year, and served until 1998.

Tenure on the Federal Bench

According to his official biography, he was nominated by President Bill Clinton on June 25, 1998, to a seat vacated by William J. Rea; confirmed by the Senate on October 21, 1998, and received his commission on October 22, 1998.

He has served on the Federal Bench for 11 years.

As a Federal Justice, Carter earned fame for his trials involving the Mexican Mafia, the Aryan Brotherhood prison gang, and Nicole Smith.

He maintains a law office in Santa Ana.

Financial Disclosures are all Blacked out?

Judge David O. Carter’s financial disclosure records for the years 2003-2008 have been published by Judicial Watch.

His filings for 2003, 2004, 2005, 2006 and 2007 are curious for the fact his statements have all been blacked out.

David O. Carter is a Common Name

Judge Carter should not be confused with several other men, in the United States, who share with him the name David O. Carter; a Laguna Beach physician, who supported Grace Napolitano for Congress in 1998, a professor of Entomology at the University of Nebraska, Lincoln, who is a published author in forensic analysis of human remains; and a laywer in Sioux Falls, South Dakota.

Someone with the name David O. Carter also enjoys boating in Lake Country, California.
